【摘要】：我國反壟斷執(zhí)法體系從上至下疊床架屋形成了商務部、國家工商總局、國家發(fā)改委和省市縣各級機構林立的執(zhí)法權配置結構。不統(tǒng)一的考量因素和非細化的裁量標準導致現實中反壟斷處罰金額起點與上限畸輕畸重。歐盟處理微軟壟斷案和美國處理微軟壟斷案分別確立了反壟斷處罰的若干考量因素和限制性適用條件。我國反壟斷法第49條的規(guī)定過于籠統(tǒng)和抽象,需要細化:統(tǒng)一行使自由酌處權的執(zhí)法機構;區(qū)別有效率和無效率兩類壟斷而分別確定其處罰的輕重;制定有梯度的處罰金額幅度,形成法律的激勵導向。
[Abstract]:From top to bottom, China's anti-monopoly law enforcement system has formed the configuration structure of the law enforcement power of the Ministry of Commerce, the State Administration of Industry and Commerce, the State Development and Reform Commission and the provincial, municipal and county agencies at all levels. Different consideration factors and non-detailed discretion standard lead to the abnormal starting point and upper limit of antitrust penalty amount in reality. The European Union deals with the Microsoft monopoly case and the United States deals with the Microsoft monopoly case, which respectively establishes some considerations and restrictive applicable conditions for antitrust punishment. The provisions of Article 49 of China's Anti-monopoly Law are too general and abstract and need to be refined: unified law enforcement agencies exercising discretionary power, distinguishing between efficient and inefficient monopolies and determining the severity of punishment respectively; Establish a gradient of the amount of punishment, to form a legal incentive guidance.
