【摘要】：當前,我國企業(yè)"走出去"的勢頭發(fā)展良好,在獲得來自國際市場的良好收益的同時,"國有身份"往往使得我國企業(yè)也面臨著在投資準入階段就折戟沉沙的風(fēng)險,在爭議發(fā)生后的投資仲裁階段也可能無辜躺槍,受到不公正的對待。本文對我國第一例國有企業(yè)在海外投資仲裁中獲得管轄權(quán)勝訴的案件——北京城建集團訴也門政府案進行具體分析,提出了我國國有企業(yè)在爭取中需要厘清的幾個問題與國際投資仲裁啟示,以期為我國國有企業(yè)海外投資保護提供參考。
[Abstract]:At present, the momentum of Chinese enterprises to "go out" is developing well. While obtaining good profits from the international market, "state-owned identity" often makes our enterprises face the risk of sinking in the stage of investment entry. The investment arbitration stage after the dispute may also be innocent and unfairly treated. This paper makes a concrete analysis of the first case in which the state-owned enterprise obtained jurisdiction over overseas investment arbitration-Beijing City Construction Group v. the Yemeni Government. This paper puts forward some problems that need to be clarified in the process of striving for the state-owned enterprises in our country and the enlightenment of international investment arbitration in order to provide reference for overseas investment protection of Chinese state-owned enterprises.
