中國(guó)自貿(mào)區(qū)法律制度的構(gòu)造及其完善

【摘要】:中國(guó)自貿(mào)區(qū)法律制度現(xiàn)已初步形成,但國(guó)家層面立法至今依然缺位,過(guò)于偏重地方性立法在一定程度上制約了區(qū)內(nèi)制度創(chuàng)新與日常管理的辦事效率,自貿(mào)區(qū)管委會(huì)授權(quán)立法與管理權(quán)限較為有限影響到其作為自貿(mào)區(qū)"一線(xiàn)"管理者參與區(qū)內(nèi)立法與運(yùn)營(yíng)管理的積極性,自貿(mào)區(qū)自由開(kāi)放與自主創(chuàng)新的優(yōu)勢(shì)特性受到羈絆,區(qū)內(nèi)市場(chǎng)活力無(wú)法得到充分釋放發(fā)揮。應(yīng)當(dāng)借鑒域外先進(jìn)自貿(mào)區(qū)歷史經(jīng)驗(yàn),遵循"法治先行"原則盡快制定出臺(tái)國(guó)家層面《中國(guó)自貿(mào)區(qū)法》引領(lǐng)指導(dǎo)中國(guó)自貿(mào)區(qū)整體建設(shè),適當(dāng)減少自貿(mào)區(qū)所在地政府對(duì)區(qū)內(nèi)事務(wù)的過(guò)度干預(yù),合理限定自貿(mào)區(qū)地方性立法權(quán)限范疇,授權(quán)自貿(mào)區(qū)管委會(huì)更多權(quán)能,激發(fā)自貿(mào)區(qū)管委會(huì)與區(qū)內(nèi)市場(chǎng)主體參與自貿(mào)區(qū)立法與管理的主觀能動(dòng)性,自貿(mào)區(qū)法律制度與管理模式需要逐步由三層級(jí)過(guò)渡升級(jí)為雙層級(jí),從而適應(yīng)自貿(mào)區(qū)制度創(chuàng)新與經(jīng)貿(mào)自由的功能作用并符合其自由開(kāi)放的內(nèi)在屬性,推進(jìn)中國(guó)自貿(mào)區(qū)戰(zhàn)略實(shí)現(xiàn)更好更快的發(fā)展。
[Abstract]:The legal system of China's free trade zone has been formed initially, but the legislation at the national level is still absent so far, too much emphasis on local legislation has restricted the efficiency of system innovation and daily management in the region to a certain extent. The limited legislative and administrative authority of the FTAC affects its enthusiasm to participate in the legislation and operation management of the FTAC as a "front-line" manager of the FTAA, and its advantages of free and open and independent innovation are fettered. Regional market vitality can not be fully released to play. We should draw lessons from the historical experience of the foreign advanced free trade zones and follow the principle of "rule of law first" to formulate and issue the China Free Trade Zone Law at the national level as soon as possible to guide the overall construction of China's free trade zones. Appropriately reducing the excessive interference of the local government of the FTAA in the affairs of the region, rationally limiting the scope of local legislative competence of the FTAA, and authorizing the FTAC to have more powers, Stimulating the subjective initiative of the FTAC and the market participants to participate in the legislation and management of the FTAZ, the FTAA legal system and management model need to be gradually upgraded from three levels to two levels. In order to adapt to the function of free trade zone system innovation and economic and trade freedom and accord with its inherent property of freedom and openness, promote the strategy of free trade area of China to achieve better and faster development.
