【摘要】：我國現(xiàn)行法并未就網(wǎng)絡(luò)干擾行為做出明確規(guī)定,因法官"造法"而創(chuàng)設(shè)的"非公益必要不干擾原則"將相對(duì)性的競爭利益提升到絕對(duì)權(quán)的保護(hù)水平,并以絕對(duì)權(quán)的排他性來劃定競爭行為的邊界。但這不僅缺乏規(guī)范依據(jù),而且嚴(yán)重偏離我國鼓勵(lì)競爭并保護(hù)創(chuàng)新的互聯(lián)網(wǎng)競爭政策。因而必須廢棄該原則,重新回歸《中華人民共和國反不正當(dāng)競爭法》一般條款的彈性評(píng)價(jià)標(biāo)準(zhǔn)。解釋論上應(yīng)以一般條款蘊(yùn)含的不正當(dāng)競爭行為構(gòu)成要件作為裁量平臺(tái),將鼓勵(lì)競爭、保護(hù)創(chuàng)新并追求公益效果的互聯(lián)網(wǎng)競爭政策作為不正當(dāng)競爭之"違法性"要件的裁量因素納入評(píng)價(jià)體系,以此重新確立網(wǎng)絡(luò)干擾行為的規(guī)制思路。
[Abstract]:The current law of our country has not made a clear stipulation on the behavior of network interference. The principle of "non-public necessity and non-interference" created by the judge "making law" promotes the relative competitive interests to the level of protection of absolute right. And the exclusive nature of absolute power to delineate the boundaries of competitive behavior. However, this is not only lack of normative basis, but also deviates from the Internet competition policy which encourages competition and protects innovation. Therefore, it is necessary to abandon the principle and return to the elastic evaluation standard of the general provisions of the Anti-unfair Competition Law of the people's Republic of China. In the interpretation theory, the constitutive elements of unfair competition contained in general clauses should be used as the discretion platform, which will encourage competition. Internet competition policy, which protects innovation and pursues public welfare effect, is brought into the evaluation system as the discretion factor of "illegality" of unfair competition, so as to re-establish the idea of network interference regulation.
