安徽郎溪縣地票交易運(yùn)行現(xiàn)狀調(diào)研報(bào)告

【摘要】:地票交易制度是我國在探索城鄉(xiāng)統(tǒng)籌發(fā)展戰(zhàn)略過程中創(chuàng)新的農(nóng)村集體土地流轉(zhuǎn)的一種方式,突破城鄉(xiāng)建設(shè)用地增減掛鉤項(xiàng)目區(qū)位的限制,充分配置城鄉(xiāng)之間的土地利用,解決城市建設(shè)用地短缺問題,又將農(nóng)村閑置土地盤活利用,增加農(nóng)民的財(cái)產(chǎn)收益。與成渝地票交易模式不同的是,安徽宣城地票分為“紅票”和“綠票”,創(chuàng)新性的將農(nóng)用地轉(zhuǎn)用計(jì)劃指標(biāo)和耕地占補(bǔ)平衡指標(biāo)納入地票概念。而且郎溪縣將地票交易制度的購買主體限定為各鄉(xiāng)鎮(zhèn)和經(jīng)濟(jì)開發(fā)區(qū),地票的最終使用者也是預(yù)先確定的即各鄉(xiāng)鎮(zhèn)(開發(fā)區(qū))用于申請地票的開發(fā)項(xiàng)目,因此郎溪縣地票實(shí)現(xiàn)土地資源配置方式由行政計(jì)劃分配單一模式逐步轉(zhuǎn)變?yōu)橛?jì)劃分配與市場競爭復(fù)合模式。由各鄉(xiāng)鎮(zhèn)(開發(fā)區(qū))根據(jù)自身用地需求,通過市場競爭方式取得用地指標(biāo),促使各鄉(xiāng)鎮(zhèn)(開發(fā)區(qū))對用地成本和土地使用效益進(jìn)行重新評估,增強(qiáng)了用地成本核算和提高使用強(qiáng)度意識。筆者深入郎溪縣進(jìn)行實(shí)地調(diào)研,了解郎溪縣地票交易制度的運(yùn)行情況,包括郎溪縣地票交易的概念、地票交易的產(chǎn)生背景、地票交易的運(yùn)行流程(包括地票產(chǎn)生、交易、使用三大階段;土地復(fù)墾、驗(yàn)收、地票交易落地四小環(huán)節(jié))、地票交易規(guī)模以及郎溪縣地票交易制度運(yùn)行至今產(chǎn)生的收獲。在掌握第一手資料的同時,筆者進(jìn)行分析發(fā)現(xiàn)由于郎溪縣地票交易制度的創(chuàng)新機(jī)制缺乏豐富的經(jīng)驗(yàn)以及運(yùn)行時間較短,很多問題慢慢顯露出來,包括地票產(chǎn)生階段存在農(nóng)民的復(fù)墾主體地位缺失、復(fù)墾區(qū)耕地質(zhì)量缺乏保障、行政權(quán)力在復(fù)墾和驗(yàn)收環(huán)節(jié)存在濫用的可能、農(nóng)民權(quán)益受損沒有及時有效的訴求機(jī)制等問題;在地票交易階段存在地票交易的市場化程度低、農(nóng)民的交易地位和交易信息不對等、復(fù)墾農(nóng)民補(bǔ)償力度低和交易收益分配缺乏統(tǒng)一管理交易等問題;在地票使用階段存在預(yù)申請項(xiàng)目以及具體落實(shí)項(xiàng)目之間前后不一,成交后的項(xiàng)目更換頻繁、競得的地票閑置、虛報(bào)申請地票項(xiàng)目等問題。這些問題的存在不利于郎溪縣地票交易制度的健康有序發(fā)展,因此筆者提出自己的完善建議,希望郎溪縣地票得以在全省范圍內(nèi)推廣。在地票產(chǎn)生階段筆者提出要建立農(nóng)民的復(fù)墾權(quán)法律保障機(jī)制、完善復(fù)墾耕地質(zhì)量的驗(yàn)收監(jiān)督體系、開放土地復(fù)墾市場以限制行政權(quán)力在復(fù)墾環(huán)節(jié)的權(quán)利、建立農(nóng)民權(quán)益保障的法律援助機(jī)制;在地票交易階段筆者建議地票交易要遵循市場化配置原則規(guī)范地票交易定價制度、確立農(nóng)民地票交易的法律主體地位、建立地票交易收益分配統(tǒng)一管理機(jī)制;在地票使用階段筆者針對郎溪縣地票產(chǎn)生的特點(diǎn)提出要加強(qiáng)招商隊(duì)伍建設(shè),建立招商項(xiàng)目組織以及明確地票預(yù)報(bào)項(xiàng)目責(zé)任主體,建立有效的監(jiān)督機(jī)制。
[Abstract]:Land ticket transaction system is an innovative way of rural collective land circulation in the process of exploring the overall development strategy of urban and rural areas. It breaks through the restrictions of the location of urban and rural construction land increase or decrease, and fully allocates the land use between urban and rural areas. To solve the problem of shortage of urban construction land, and to revitalize the idle land in rural areas to increase the property income of farmers. Different from Chengdu-Chongqing ticket trading model, Anhui Xuancheng land ticket is divided into "red vote" and "green vote". In addition, Langxi County limited the purchase subject of the land ticket trading system to each township and economic development zone, and the end-user of the ticket was also pre-determined, that is, each township (development zone) was used to apply for the development project of the land ticket. Therefore, the land resources allocation mode in Langxi County is gradually changed from the single mode of administrative plan distribution to the compound mode of plan distribution and market competition. Each township (development zone) shall, according to its own land demand, obtain the land use index by means of market competition, so as to urge each township (development zone) to reassess the land use cost and land use benefit. Increased land cost accounting and use of the intensity of awareness. In order to understand the operation of land ticket trading system, including the concept of land ticket transaction in Langxi County, the background of land ticket transaction, the operation process of land ticket transaction (including the generation of land ticket, the transaction of land ticket), the author conducted field investigation in Langxi County. Use three major stages: land reclamation, acceptance, land ticket transaction landing four small links), land ticket trading scale and Langxi County land ticket trading system so far produced the results. At the same time of mastering first-hand information, the author analyzes and finds that due to the lack of rich experience in the innovative mechanism of the land ticket trading system in Langxi County and the short running time, many problems have been gradually revealed. The problems include the lack of farmers' main status of reclamation, the lack of guarantee of cultivated land quality in reclamation area, the possibility of abuse of administrative power in reclamation and acceptance, and the lack of timely and effective appeal mechanism for the damage of farmers' rights and interests. In the stage of land ticket trading, there are some problems, such as low marketization degree of land ticket transaction, unequal transaction status and information of farmers, low compensation of farmers and lack of unified management of transaction income distribution. In the stage of ticket use there are inconsistency between the pre-application items and the specific implementation of the project. After the transaction the items are replaced frequently the land ticket of the auction is idle and the items of false application are not reported. The existence of these problems is not conducive to the healthy and orderly development of the land ticket trading system in Langxi County, so the author puts forward his own perfect suggestions, hoping that the land ticket in Langxi County can be popularized throughout the province. At the stage of land ticket generation, the author puts forward that we should establish the legal guarantee mechanism of farmers' reclamation right, perfect the acceptance supervision system of cultivated land quality, open the land reclamation market to limit the right of administrative power in the reclamation link. In the stage of land ticket transaction, the author suggests that the land ticket transaction should follow the principle of market allocation, standardize the pricing system of land ticket transaction, and establish the legal subject status of the land ticket transaction. In the stage of land ticket use, the author proposes to strengthen the construction of investment promotion team, to establish the project organization and to make sure that the main body responsible for the ticket forecasting project is clear, according to the characteristics of land ticket production in Langxi County, and to establish the unified management mechanism of income distribution of land ticket transaction. Establish an effective monitoring mechanism.
