【摘要】：創(chuàng)新是人類社會(huì)的永恒主題,意味著將新知識(shí)適用于產(chǎn)業(yè)發(fā)展,亦可能引發(fā)市場(chǎng)、社會(huì)結(jié)構(gòu)的重大變革。目前以分享經(jīng)濟(jì)為代表的創(chuàng)新實(shí)踐受到了普遍關(guān)注,在帶來(lái)諸多益處的同時(shí),也對(duì)政府規(guī)制產(chǎn)生了挑戰(zhàn)。為了使規(guī)制與創(chuàng)新能夠盡量保持同步,政府要在充分了解創(chuàng)新特征的基礎(chǔ)之上,處理好是否規(guī)制、何時(shí)規(guī)制、規(guī)制方式的選擇、規(guī)制時(shí)限的設(shè)定以及規(guī)制實(shí)施效果的評(píng)價(jià)等問(wèn)題,從而實(shí)現(xiàn)創(chuàng)新和規(guī)制的良性互動(dòng)。在規(guī)制應(yīng)對(duì)層面,除應(yīng)該發(fā)揮自我規(guī)制的作用外,政府要發(fā)展試驗(yàn)性規(guī)制的理念,只有這樣才能找到促進(jìn)創(chuàng)新和保護(hù)公眾安全的平衡點(diǎn),才能形成多元參與、合作有序的規(guī)制和治理體系。
[Abstract]:Innovation is the eternal theme of human society, which means the application of new knowledge to the development of industry, which may also lead to great changes in market and social structure. At present, the innovation practice represented by the sharing economy has received widespread attention, which brings many benefits, but also challenges the government regulation. In order to keep the synchronization between regulation and innovation as far as possible, the government should deal with the choice of regulation, when and how to regulate, on the basis of fully understanding the characteristics of innovation. In order to realize the positive interaction between innovation and regulation, the establishment of regulation time limit and the evaluation of the effect of regulation implementation are discussed. In the regulatory response level, in addition to the role of self-regulation, the government should develop the concept of experimental regulation, only in this way can we find a balance point to promote innovation and protect public safety, and form multiple participation. Cooperation and orderly regulation and governance system.
