我國農業(yè)豁免問題的再探討——以《反壟斷法》56條為依據(jù)

【摘要】：農業(yè)是經濟發(fā)展的基礎,是工業(yè)現(xiàn)代化的保障,對其進行相應的豁免已是各國的共識。我國《反壟斷法》第56條規(guī)定:"農業(yè)生產者及農村經濟組織在農產品生產、加工、銷售、運輸、儲存等經營活動中實施的聯(lián)合或者協(xié)同行為,不適用本法。"該法條是我國對農業(yè)豁免的核心依據(jù),不僅規(guī)定了農業(yè)豁免的主體,還對農業(yè)經營的范圍和行為進行了界定。但在適用過程中,此法條的農業(yè)經營主體,農業(yè)和農產品的概念內涵、外延不統(tǒng)一,這勢必會影響農業(yè)豁免的順利實施。本文以56條為依據(jù),對主要爭議的問題進行梳理,達到農業(yè)豁免再認知的目的。
[Abstract]:Agriculture is the foundation of economic development and the guarantee of industrial modernization. Article 56 of the Anti-monopoly Law of China states: "this Law shall not apply to joint or synergistic activities carried out by agricultural producers and rural economic organizations in the production, processing, marketing, transportation and storage of agricultural products." This article is the core basis of agricultural exemption in our country. It not only stipulates the subject of agricultural exemption, but also defines the scope and behavior of agricultural management. However, in the process of application, the agricultural management subject, the concept connotation and extension of agriculture and agricultural products are not unified, which will inevitably affect the smooth implementation of agricultural exemption. On the basis of 56 articles, this paper combs the main controversial issues to achieve the purpose of recognition of agricultural exemption.
