【摘要】：1978-2000年間,商品經(jīng)濟發(fā)展與金融體系資金供給不足的矛盾是民間借貸得以存在的條件。金融體制改革初期,法律法規(guī)的不健全及政府、銀行部門的包容,給民間借貸提供了發(fā)展契機。金融體制改革的深化,確立了以國有銀行為代表的正規(guī)金融機構(gòu)對金融市場的壟斷地位,而嚴厲的金融管制使民間金融活動面臨非法集資的窘境。對民間借貸在金融市場中的合理定位,及正確評估其對市場經(jīng)濟發(fā)展的影響,是決定法律對民間借貸應(yīng)采取何種規(guī)制模式的關(guān)鍵。
[Abstract]:From 1978 to 2000, the contradiction between the development of commodity economy and the insufficient supply of funds in the financial system was the condition for the existence of private lending. At the beginning of the reform of financial system, the imperfect laws and regulations and the tolerance of the government and the banking sector provided opportunities for the development of private lending. With the deepening of the reform of the financial system, the monopoly position of the formal financial institutions, represented by the state-owned banks, over the financial market has been established, and strict financial control has made private financial activities face the dilemma of illegal fund-raising. The rational orientation of private lending in the financial market and the correct evaluation of its influence on the development of market economy are the key to decide what kind of regulation mode the law should adopt to private lending.
