預(yù)付式消費(fèi)法律規(guī)制
[Abstract]:In recent years, with more and more prepaid consumption, more and more people enter into life, behind the seemingly win-win bright surface, The risk of prepaid consumption is becoming increasingly apparent: because prepaid consumer cards require consumers to pay a certain price or fee in advance, and often in large amounts, once merchants refuse to provide services or provide defective services after charging membership fees, In addition, because of the large amount of transactions involved, and most of them have the function of bearer and negotiable payment instrument, it provides a hotbed for enterprises, individuals to evade tax and take bribes. However, the legal regulation of prepaid consumption in China is not optimistic. The first part of this paper analyzes the existing problems and social phenomena of prepaid consumption in China through the empirical analysis of Kingsberg case, which includes the insufficient basis of government supervision, the spread of unfair competition, the lack of protection of consumers' rights and interests, and the breeding of corruption. Money laundering, challenge tax management system and so on. The second part is about the current law of our country about the prepaid consumption regulation of a concentrated combing, through the legal level, sector regulation level, other normative document level and local laws and regulations level of prepaid consumption norms. This paper analyzes the problems behind the existing legal regulations and finds a starting point for the introduction of regional advanced experience. The third part is the investigation and comparison of the advanced experiences in various regions. Through the investigation and comparison of the norms of American value storage cards, the provisions of Japanese prepaid certificates and the norms of gift coupons in Taiwan, the author hopes to find a way or method to use for reference, and to provide help for establishing and perfecting the legal regulation of prepaid consumption in our country. The fourth part is my suggestions on the legal regulation of prepaid consumption in China, from defining the legal position to clarifying the legal basis of regulation, from standardizing legislation to perfecting the supervision mechanism. In order to complete the idea of China's prepaid consumption legal system in the way of layer by layer cocoon stripping.
