【摘要】：2013年11月9日中共十八屆三中全會(huì)作出《中共中央關(guān)于全面深化改革若干重大問題的決定》(以下簡稱“《決定》”),該《決定》為農(nóng)村地區(qū)的土地制度改革指明了新的方向,首次提出“鼓勵(lì)和引導(dǎo)工商資本到農(nóng)村發(fā)展適合企業(yè)化經(jīng)營的現(xiàn)代種養(yǎng)業(yè),向農(nóng)業(yè)輸入現(xiàn)代生產(chǎn)要素和經(jīng)營模式”,“鼓勵(lì)社會(huì)資本投向農(nóng)村建設(shè),允許企業(yè)和社會(huì)組織在農(nóng)村興辦各類事業(yè)”,為社會(huì)資本進(jìn)入我國農(nóng)村地區(qū)、參與農(nóng)村地區(qū)的土地流轉(zhuǎn),提供了政策依據(jù)。然而,社會(huì)資本如何投向農(nóng)村土地流轉(zhuǎn)實(shí)踐,在具體制度完善上,國家并沒有做出具體明確的規(guī)定,現(xiàn)有的研究成果盡管也涉及到社會(huì)資本投向農(nóng)村土地流轉(zhuǎn)的論述,但就以信托這種模式參與農(nóng)村土地流轉(zhuǎn)的研究并不多,大部分的研究也僅僅停留在對現(xiàn)有農(nóng)地信托流轉(zhuǎn)實(shí)踐探索的分析和總結(jié)上。本文在此基礎(chǔ)上,對農(nóng)地信托流轉(zhuǎn)這一問題作進(jìn)一步的研究。首先,在大量文獻(xiàn)資料和數(shù)據(jù)資料的基礎(chǔ)上,本文對農(nóng)地流轉(zhuǎn)的概念和政策法規(guī)依據(jù)進(jìn)行了詳細(xì)介紹,并對我國農(nóng)村地區(qū)目前的農(nóng)地利用現(xiàn)狀和農(nóng)地流轉(zhuǎn)情況作了詳細(xì)的分析,并由此指出當(dāng)前我國農(nóng)地流轉(zhuǎn)存在的問題。其次,提出解決當(dāng)前我國農(nóng)地流轉(zhuǎn)問題的制度創(chuàng)新——農(nóng)地信托流轉(zhuǎn),并著重分析了農(nóng)地信托流轉(zhuǎn)在我國農(nóng)村地區(qū)實(shí)行的可行性和必要性。緊接著,本文對我國農(nóng)村地區(qū)實(shí)行信托流轉(zhuǎn)涉及到的主要法律關(guān)系簡要梳理,主要包括信托財(cái)產(chǎn)的界定與適格、信托法律關(guān)系當(dāng)事人的界定及其權(quán)利義務(wù)關(guān)系,農(nóng)地信托登記的內(nèi)容、效力等等。最后,根據(jù)當(dāng)前我國農(nóng)地信托流轉(zhuǎn)法律制度在實(shí)踐中可能遇到的法律問題,提出完善的建議。本文的主要?jiǎng)?chuàng)新點(diǎn)主要有兩點(diǎn):1)角度的創(chuàng)新,將金融學(xué)領(lǐng)域的信托制度引入農(nóng)村土地流轉(zhuǎn)政策中,從跨學(xué)科的角度對當(dāng)前我國農(nóng)村地區(qū)的土地流轉(zhuǎn)存在的問題提出了新的解決方案;2)在分析我國農(nóng)村土地流轉(zhuǎn)中引入信托機(jī)制的原因時(shí),本文從農(nóng)村普惠金融和共有制實(shí)現(xiàn)的角度,提出了自己的獨(dú)到見解。此外,本文還就農(nóng)地信托流轉(zhuǎn)法律關(guān)系當(dāng)事人的界定和權(quán)利義務(wù)體系等提出了自己的獨(dú)到見解。
[Abstract]:On November 9, 2013, the third Plenary session of the 18th CPC Central Committee made the "decision of the CPC Central Committee on the Comprehensive deepening of several important issues" (hereinafter referred to as "the decision"), which pointed out a new direction for the reform of the land system in rural areas. It is the first time to "encourage and guide industrial and commercial capital to develop a modern planting and raising industry suitable for enterprise management in rural areas, and import modern production elements and business models into agriculture" and "encourage social capital to invest in rural construction." Enterprises and social organizations are allowed to set up various undertakings in rural areas, which provides a policy basis for social capital to enter rural areas and participate in land circulation in rural areas. However, there are no specific regulations on how to put social capital into the practice of rural land circulation. Although the existing research results also involve the discussion of social capital investment in rural land circulation, However, there are not many researches on the rural land circulation by trust, and most of the research is only on the analysis and summary of the practice and exploration of the rural land trust circulation. On this basis, this paper makes a further study on the issue of farmland trust circulation. First of all, on the basis of a large number of documents and data, this paper introduces the concept, policies and regulations of agricultural land transfer in detail, and makes a detailed analysis of the current situation of farmland utilization and farmland transfer in rural areas of China. And from this point out the current agricultural land circulation existing problems. Secondly, the paper puts forward the system innovation to solve the problem of agricultural land transfer in our country, and analyzes the feasibility and necessity of carrying out farmland trust transfer in rural areas of our country. Then, this paper briefly combs the main legal relations involved in the transfer of trust in rural areas of China, including the definition and suitability of trust property, the definition of parties to trust legal relationship and the relationship between rights and obligations. The content, effect and so on of farmland trust registration. Finally, according to the legal problems that may be encountered in the practice of the current legal system of farmland trust circulation in our country, some suggestions are put forward. The main innovation points of this paper are two points: 1). The trust system in the field of finance is introduced into the policy of rural land circulation. This paper puts forward a new solution to the problems existing in the land circulation in the rural areas of our country from an interdisciplinary point of view, and analyzes the reasons for the introduction of the trust mechanism in the rural land circulation in China. From the perspective of rural inclusive finance and the realization of co-ownership system, this paper puts forward its own unique views. In addition, this paper also puts forward his own unique views on the definition and system of rights and obligations of the parties involved in the legal relationship of farmland trust circulation.
