【摘要】：一直以來我國(guó)政府投資項(xiàng)目領(lǐng)域帶有濃厚的計(jì)劃經(jīng)濟(jì)色彩，政府不僅是工程建設(shè)項(xiàng)目的投資人，還是工程項(xiàng)目管理人，致使投資失控、工期拖延、質(zhì)量不保等現(xiàn)象層出不窮。國(guó)務(wù)院正式出臺(tái)的《關(guān)于投資體制改革的決定》意味著代建制正式確立，，之后形成廈門、北京、上海、重慶四大模式。 我國(guó)代建制研究起步晚、研究出發(fā)點(diǎn)較為片面，多集中在代建企業(yè)的風(fēng)險(xiǎn)評(píng)估、風(fēng)險(xiǎn)管理、資金管理及投資控制等方面，法律領(lǐng)域研究則較少，多集中在代建企業(yè)面臨的法律風(fēng)險(xiǎn)及應(yīng)對(duì)方面，而從政府角度研究代建項(xiàng)目的法律風(fēng)險(xiǎn)更是少之又少。研究政府投資項(xiàng)目代建的法律風(fēng)險(xiǎn)防控，有利于完善我國(guó)政府投資法規(guī)體系，為代建制的順利推行提供學(xué)術(shù)支持，從而發(fā)揮代建人專業(yè)管理的優(yōu)勢(shì)，規(guī)范政府投資行為。 本論文在參考大量學(xué)術(shù)成果、各地方代建制管理辦法及相關(guān)法律規(guī)定基礎(chǔ)上，首先介紹代建制的基本理論及發(fā)展現(xiàn)狀，從經(jīng)濟(jì)法角度分析代建制面臨的法律規(guī)范缺失、市場(chǎng)準(zhǔn)入監(jiān)管不嚴(yán)、招投標(biāo)管理不規(guī)范、審計(jì)監(jiān)督較弱、政府投資決策法律責(zé)任追究乏力五方面法律風(fēng)險(xiǎn)，并借鑒國(guó)外公共工程項(xiàng)目管理的經(jīng)驗(yàn)基礎(chǔ)上結(jié)合我國(guó)實(shí)際從立法、執(zhí)法、司法三大方面提出政府投資項(xiàng)目代建法律風(fēng)險(xiǎn)防控對(duì)策。
[Abstract]:Our country government investment project domain all the time has the strong planned economy color, the government is not only the project construction project investor, also the project manager, causes the investment to lose control, the time limit delay, the quality is not guaranteed and so on phenomenon one after another. The decision on the reform of the investment system issued by the State Council means the establishment of the agent system, and then the formation of four major models: Xiamen, Beijing, Shanghai and Chongqing. The research on agent system in China started late and started from a one-sided point. It mainly focuses on the risk assessment, risk management, capital management and investment control of the agent construction enterprises, while the research in the legal field is less. Most of them focus on the legal risks and countermeasures faced by agency construction enterprises, but the legal risks of agency construction projects are less and less from the angle of government. The study of legal risk prevention and control of government investment projects is conducive to perfecting the system of government investment laws and regulations, providing academic support for the smooth implementation of the agency system, thus giving full play to the advantages of professional management of agents and standardizing government investment behavior. On the basis of a large number of academic achievements, management methods and relevant laws and regulations, this paper first introduces the basic theory and development status of the agent system, and analyzes the lack of legal norms faced by the agency system from the point of view of economic law. The supervision of market access is not strict, the management of bidding is not standardized, the audit supervision is weak, and the legal responsibility of government investment decision is investigated for lack of five aspects of legal risks. On the basis of drawing lessons from the experience of foreign public works project management, combining with the actual legislation of our country, Three major aspects of law enforcement and justice put forward government investment projects on behalf of legal risk prevention and control countermeasures.
