【摘要】：作為互聯(lián)網(wǎng)金融中具有創(chuàng)新性的產(chǎn)物,比特幣本身擁有獨(dú)特的運(yùn)行機(jī)制,具備去中心化、匿名性、開放性以及總量的有限性等特點(diǎn)。在給人們的生活帶來新穎理念和極大沖擊力的同時(shí),由其本身的獨(dú)特性又引發(fā)了諸多法律問題、帶來了很大的挑戰(zhàn)。本文的寫作目的便在于探究比特幣是什么,其法律屬性應(yīng)當(dāng)如何認(rèn)定,以及比特幣在蓬勃發(fā)展的數(shù)年內(nèi),帶來的諸多問題與挑戰(zhàn),并針對(duì)所體現(xiàn)出的問題和挑戰(zhàn),積極尋求規(guī)制比特幣、應(yīng)對(duì)其挑戰(zhàn)的策略。第一部分,本文從比特幣產(chǎn)生、交易支付以及在世界各國的發(fā)展情況等方面介紹比特幣的基本情況,說明并闡述比特幣匿名性、去中心化、有限性與可分割性以及開放性等特點(diǎn)。第二部分,本文對(duì)比了當(dāng)前學(xué)界對(duì)于比特幣貨幣屬性的“貨幣說”及“非貨幣說”等主要觀點(diǎn),并通過貨幣本質(zhì)、貨幣的職能以及與主權(quán)貨幣關(guān)系等方面論述,得出比特幣當(dāng)前并不適合作為貨幣的結(jié)論。第三部分,本文結(jié)合比特幣自身特點(diǎn)可能引發(fā)的風(fēng)險(xiǎn),發(fā)展至當(dāng)前階段所暴露出的問題,以及對(duì)現(xiàn)有體制造成的沖擊,對(duì)比特幣所引發(fā)的法律問題進(jìn)行了闡述,總結(jié)出比特幣帶來的法律空白、法律救濟(jì)困難、投機(jī)性過強(qiáng)導(dǎo)致的交易風(fēng)險(xiǎn)、使用比特幣的洗錢和非法交易行為、交易平臺(tái)準(zhǔn)入門檻低和監(jiān)管的不足、以及對(duì)現(xiàn)行貨幣體系帶來的沖擊等數(shù)個(gè)問題和風(fēng)險(xiǎn)。第四部分則是針對(duì)既存及可能出現(xiàn)的問題和挑戰(zhàn),嘗試性地提出規(guī)制比特幣、應(yīng)對(duì)其挑戰(zhàn)和風(fēng)險(xiǎn)的策略建議,具體包括:明確比特幣的屬性,認(rèn)為依據(jù)五部委所發(fā)的《通知》,比特幣不應(yīng)作為貨幣流通,不是真正意義的貨幣,根據(jù)其自身特點(diǎn)可以認(rèn)定為特殊的物,具備法律意義上財(cái)產(chǎn)的特征,可以依據(jù)現(xiàn)行法律進(jìn)行規(guī)制和保障,并需完善法律規(guī)定,以保證比特幣的相關(guān)法律問題適用;加強(qiáng)建設(shè)比特幣的保障和救濟(jì)體系,確保合法權(quán)益的保障途徑;規(guī)范比特幣交易平臺(tái)、強(qiáng)化監(jiān)管,建立交易制度及完善風(fēng)險(xiǎn)防控體系;進(jìn)行比特幣實(shí)名化的建設(shè);加強(qiáng)國際交流與合作,共享比特幣監(jiān)控信息,以建立打擊比特幣犯罪、解決比特幣糾紛的國際合作基礎(chǔ);完善統(tǒng)計(jì)制度,以保障國家對(duì)比特幣在市場(chǎng)流動(dòng)狀態(tài)的監(jiān)控等。
[Abstract]:As an innovative product of Internet finance, Bitcoin has its own unique operating mechanism, such as decentralization, anonymity, openness and finiteness of total amount. While bringing new ideas and great impact to people's life, its uniqueness has caused many legal problems and brought great challenges. The purpose of this paper is to explore what Bitcoin is, how its legal attributes should be determined, and the problems and challenges brought by Bitcoin in the years of vigorous development. Actively seek to regulate Bitcoin, to deal with its challenges strategy. In the first part, this paper introduces the basic situation of Bitcoin from the aspects of bitcoin generation, transaction payment and the development of Bitcoin in the world, and explains and expounds the anonymity of bitcoin and its decentralization. Finiteness, separability and openness. In the second part, this paper compares the current academic views on Bitcoin's monetary attribute, such as "currency theory" and "non-monetary theory", and discusses the nature of money, the function of currency and the relationship with sovereign currency, etc. Come to the conclusion that Bitcoin is not a currency at the moment. In the third part, according to the risks caused by the characteristics of Bitcoin, the problems exposed in the current stage, and the impact on the existing system, the legal problems caused by Bitcoin are expounded. Summing up the legal gaps brought about by Bitcoin, the difficulties of legal relief, the trading risks caused by speculative excesses, money laundering and illegal transactions using Bitcoin, the low barriers to entry and inadequate supervision of trading platforms, And the impact on the current monetary system and other issues and risks. In the fourth part, aiming at the existing and possible problems and challenges, the author tries to put forward some strategic suggestions to regulate Bitcoin and deal with its challenges and risks, including: defining the nature of Bitcoin. Considering that according to the circular issued by the five ministries, Bitcoin should not be used as currency in circulation and is not a currency of real significance. According to its own characteristics, it can be recognized as a special object with the characteristics of property in the legal sense. It can be regulated and guaranteed according to the current law, and it needs to perfect the legal provisions to ensure the application of the relevant legal problems of Bitcoin, to strengthen the protection and relief system of Bitcoin, and to ensure the safeguard of legitimate rights and interests. Standardizing Bitcoin trading platforms, strengthening supervision, establishing trading systems and perfecting risk prevention and control systems; carrying out bitcoin real-name construction; strengthening international exchanges and cooperation, sharing bitcoin monitoring information, in order to establish a crackdown on bitcoin crime, The basis of international cooperation in resolving bitcoin disputes and the improvement of statistical system in order to ensure the state monitoring of Bitcoin flow in the market.
