民航空防安全管理問(wèn)題的法社會(huì)學(xué)探究

【摘要】:中國(guó)在現(xiàn)代化進(jìn)程中經(jīng)過(guò)30多年的經(jīng)濟(jì)騰飛,國(guó)民收入劇增,按照購(gòu)買(mǎi)力平價(jià)計(jì)算已是世界上最大的經(jīng)濟(jì)體。伴隨著全球化和現(xiàn)代化的發(fā)展,中國(guó)社會(huì)業(yè)已進(jìn)入“風(fēng)險(xiǎn)社會(huì)”時(shí)代。航空業(yè)作為專家系統(tǒng)之一是典型的“現(xiàn)代性的后果”,人們?cè)谙硎鼙憷耐瑫r(shí),也在承擔(dān)著包括科技和制度在內(nèi)的各種彌散的風(fēng)險(xiǎn)。與風(fēng)險(xiǎn)相對(duì)的概念——安全,已然成為航空業(yè)這一對(duì)國(guó)家政治穩(wěn)定、經(jīng)濟(jì)建設(shè)有重大意義之行業(yè)的核心價(jià)值。由于全球化和科技發(fā)展,來(lái)自國(guó)際恐怖主義、國(guó)內(nèi)民族分裂勢(shì)力和宗教極端勢(shì)力顯露出風(fēng)險(xiǎn)的全球化特點(diǎn),負(fù)有空防安全責(zé)任的政府主體虛位導(dǎo)致“有組織的不負(fù)責(zé)任”是影響民航業(yè)風(fēng)險(xiǎn)治理的又一困境,而來(lái)自廣大旅客愈演愈烈的非法干擾事件也讓我們看到風(fēng)險(xiǎn)社會(huì)的根本問(wèn)題是人的問(wèn)題。同時(shí)相關(guān)法規(guī)的滯后凸顯出作為一種社會(huì)控制的空防安全管理在民航這一半自治領(lǐng)域的運(yùn)行窘境。對(duì)于以上影響民航空防安全的各種威脅,筆者試圖以風(fēng)險(xiǎn)社會(huì)的視角,結(jié)合社會(huì)控制和半自治社會(huì)理論去分析其間的社會(huì)學(xué)原因,并結(jié)合多年的空防工作一線經(jīng)驗(yàn),去尋求解決之道,嘗試以制度的堤壩來(lái)加固民航空防安全事業(yè)。
[Abstract]:After more than 30 years of economic takeoff in the process of modernization, China's national income has increased sharply, and it is already the largest economy in the world in terms of purchasing power parity (PPP). With the development of globalization and modernization, Chinese society has entered the era of risk society. As one of the expert systems, aviation industry is a typical "consequence of modernity", people are enjoying convenience, but also bearing various kinds of diffusing risks, including science and technology and system. The concept of safety, as opposed to risk, has become the core value of the aviation industry, an industry of great significance for national political stability and economic construction. As a result of globalization and the development of science and technology, as a result of international terrorism, domestic ethnic separatist forces and religious extremist forces have shown the globalization characteristics of risk. "organized irresponsibility" caused by the false position of the government body with the responsibility for air defense safety is another dilemma affecting the civil aviation industry's risk management. The increasing illegal interference from the vast number of tourists also let us see that the fundamental problem of the risk society is the human problem. At the same time, the lag of relevant laws and regulations highlights the operational dilemma of air defense safety management as a kind of social control in this half autonomous field of civil aviation. For the above threats affecting civil aviation air defense safety, the author tries to analyze the sociological reasons from the perspective of risk society, combined with the theory of social control and semi-autonomous society, and combined with years of air defense work experience. To find a solution, try to strengthen civil aviation air safety with institutional levees.
