【摘要】：WTO《貿(mào)易便利化協(xié)定》體現(xiàn)了貿(mào)易便利化與海關(guān)監(jiān)管既相互對立又相互策應(yīng)的互動關(guān)系。在涉及諸多改善通關(guān)環(huán)境、提高通關(guān)時效因素方面,將爭議置于進(jìn)口貨物之前,包括稅則歸類、原產(chǎn)地認(rèn)定,還包括完稅價格認(rèn)定、關(guān)稅減免的訴求和關(guān)稅配額,甚至提供更加寬泛的兜底條款范圍均可納入預(yù)裁定范疇,是該協(xié)定最令人矚目的貢獻(xiàn)之一,也是我國政府盡快履行《貿(mào)易便利化協(xié)定》議定書的重要義務(wù)。我國應(yīng)審時度勢地修訂《海關(guān)法》和《海關(guān)行政裁定管理暫行辦法》,界定預(yù)裁定定義和適用范圍,增加其接受行政復(fù)議和行政訴訟的法定程序,簡化預(yù)裁定程序,并統(tǒng)籌"三預(yù)"相關(guān)立法,期冀全面提高海關(guān)執(zhí)法水平和推進(jìn)貿(mào)易便利化進(jìn)程。
[Abstract]:The Agreement on Trade Facilitation of WTO embodies the interaction between trade facilitation and customs supervision. With regard to the many factors involved in improving the customs clearance environment and increasing the timeliness of customs clearance, disputes are put before imported goods, including the classification of tax rules, determination of origin, determination of customs payment prices, demands for tariff reduction and tariff quotas, It is one of the most remarkable contributions to the agreement and the important obligation of our government to fulfill the protocol of the Agreement on Trade Facilitation as soon as possible. China should revise the Customs Law and the interim measures for the Administration of Customs Administrative decisions, define the definition and scope of application of pre-adjudication, increase its legal procedures for accepting administrative reconsideration and administrative litigation, and simplify the procedures for pre-adjudication. We hope to improve the level of customs enforcement and promote the process of trade facilitation.
