【摘要】：日本《禁止壟斷法》制定于二戰(zhàn)后美國(guó)占領(lǐng)下的民主化改革時(shí)期,既有仿效美國(guó)《反托拉斯法》的特點(diǎn),也因歷史文化、政治經(jīng)濟(jì)等因素而具有與美國(guó)不同的特色,如條款規(guī)定相對(duì)寬松、執(zhí)行體制行政色彩較濃等。隨著經(jīng)濟(jì)高速增長(zhǎng)結(jié)束、國(guó)內(nèi)市場(chǎng)化程度不斷提高,日本開(kāi)始修改和強(qiáng)化《禁止壟斷法》,尤其90年代中期以后,在放松政府規(guī)制的趨勢(shì)下,日本日益重視發(fā)揮《禁止壟斷法》的作用,以促進(jìn)公正自由的市場(chǎng)競(jìng)爭(zhēng)。進(jìn)入21世紀(jì),為適應(yīng)新形勢(shì),日本多次修改《禁止壟斷法》,揭示了日本競(jìng)爭(zhēng)政策的發(fā)展方向,即更多地運(yùn)用于以往的規(guī)制領(lǐng)域、增加和強(qiáng)化法律執(zhí)行手段、提高執(zhí)行機(jī)構(gòu)的公正性和公開(kāi)性、加強(qiáng)部門(mén)之間的協(xié)調(diào)和國(guó)民監(jiān)督、與普遍認(rèn)可的競(jìng)爭(zhēng)規(guī)則接軌。
[Abstract]:Japan's "Prohibition of Ridge Law" was formulated in the period of democratization reform under the occupation of the United States after World War II. It not only emulated the characteristics of the United States' Anti-Trust Law, but also had different characteristics from that of the United States because of historical, cultural, political and economic factors. If the provisions are relatively loose, the executive system is more administrative color and so on. With the end of rapid economic growth and the increasing degree of domestic marketization, Japan began to revise and strengthen the Prohibition of Ridge cutting Law, especially after the mid-1990s, under the trend of loosening government regulations. Japan pays more and more attention to promoting fair and free market competition. In the 21st century, in order to adapt to the new situation, Japan has repeatedly revised the "Prohibition of Ridge cutting Law", which reveals the development direction of Japan's competition policy, that is, it is more used in the field of regulation in the past to increase and strengthen the means of law enforcement. To improve the fairness and openness of the executing agencies, to strengthen the coordination between departments and national supervision, and to conform to the generally accepted competition rules.
