【摘要】：針對我國經(jīng)濟(jì)法司法理論研究"碎片化"的現(xiàn)狀,需要在既有理論的基礎(chǔ)上加以拓補(bǔ)和整合;由于司法權(quán)、司法權(quán)的行使主體及其價值追求,既是司法理論必不可少的重要內(nèi)容,又是進(jìn)行理論拓補(bǔ)的重要路徑,因而在構(gòu)建和拓展經(jīng)濟(jì)法司法理論的過程中,尤其需要研究司法權(quán)與調(diào)制權(quán)的關(guān)系,明晰法院解決"經(jīng)濟(jì)法紛爭"與實(shí)現(xiàn)公共政策目標(biāo)的雙重司法功能,探討法院體系及其內(nèi)部結(jié)構(gòu)與上述功能的關(guān)聯(lián)性和一致性,以及經(jīng)濟(jì)法多元價值的淵源及其在司法活動中的體現(xiàn),并在此基礎(chǔ)上,提煉司法權(quán)理論、司法組織理論和司法價值理論,從而構(gòu)建更為系統(tǒng)的經(jīng)濟(jì)法司法理論,促進(jìn)經(jīng)濟(jì)法領(lǐng)域的司法制度的完善。
[Abstract]:In view of the current situation of "fragmentation" of the judicial theory of economic law in China, it is necessary to supplement and integrate it on the basis of existing theories, because of the judicial power, the subject of judicial power and the pursuit of its value. It is not only an essential content of judicial theory, but also an important way to carry out theoretical supplement. Therefore, in the process of constructing and expanding the judicial theory of economic law, it is especially necessary to study the relationship between judicial power and modulation power. To clarify the dual judicial function of the court to resolve the disputes in economic law and to achieve the goal of public policy, and to explore the relevance and consistency of the court system and its internal structure with the above-mentioned functions. On the basis of this, the author abstracts the theory of judicial power, the theory of judicial organization and the theory of judicial value, so as to construct a more systematic judicial theory of economic law. To promote the improvement of the judicial system in the field of economic law.
