【摘要】：源于對我國上一輪國企改革中國資巨額流失的心有余悸,以及對國企經(jīng)營者"內(nèi)部人控制"的深度擔(dān)憂,實踐中,對國有資產(chǎn)流失的認(rèn)定存在著諸多偏差。這直接抑制了國企經(jīng)營者的改革動力,制約了改革的深化和市場機制的進一步完善。為此,今后我國立法者應(yīng)摒棄國有資本的"剛性資本"思維,堅持"行為規(guī)制"理念,從價格評估機制的市場化、競價交易機制的透明化以及經(jīng)營中國資流失認(rèn)定的合理化角度對現(xiàn)行法予以修正,從而既保護國有資產(chǎn)安全,又有效推動改革,提升改革效率。
[Abstract]:In practice, there are many deviations in the determination of the loss of state-owned assets due to the palpation of the huge loss of Chinese capital in the last round of SOE reform and the deep concern about the "insider control" of SOE operators. This directly restrains the reform motive force of the state-owned enterprise operator, restricts the deepening of the reform and the further improvement of the market mechanism. Therefore, in the future, Chinese legislators should abandon the thinking of "rigid capital" of state-owned capital, adhere to the idea of "behavior regulation", and start with the marketization of price evaluation mechanism. The transparency of the bidding trading mechanism and the rationalization of the management of Chinese capital loss can not only protect the security of state-owned assets, but also effectively promote the reform and improve the efficiency of the reform.
