【摘要】：現(xiàn)今,國際金融危機(jī)深層次影響繼續(xù)顯現(xiàn),世界經(jīng)濟(jì)呈下行的趨勢,而國內(nèi)經(jīng)濟(jì)則步入“新常態(tài)”。在此情形下,為了保證頂層戰(zhàn)略設(shè)計下的經(jīng)濟(jì)要素有序流動、資源高效配置和市場深度融合,我國的金融領(lǐng)域需要進(jìn)一步對外開放,銀行業(yè)對外資的開放就是其中重要的一環(huán)。然而,掌握國民經(jīng)濟(jì)和金融經(jīng)濟(jì)運行命脈的銀行業(yè),萬一經(jīng)營不善或者發(fā)生經(jīng)營危機(jī),不僅阻礙金融界的穩(wěn)定發(fā)展,也會波及到國民經(jīng)濟(jì)的正常運行。從法規(guī)的角度出發(fā),對銀行的監(jiān)管手段進(jìn)行研究、通過法律手段規(guī)范銀行業(yè),對促進(jìn)銀行業(yè)健康平穩(wěn)發(fā)展具有重要的意義。本文的主要研究內(nèi)容主要分為以下三個部分,第一章分析了中國的經(jīng)濟(jì)現(xiàn)狀以及外資銀行對中國的意義;參照美國在經(jīng)濟(jì)發(fā)展過程中所遇到的相似問題,比較兩國的立法歷程,找準(zhǔn)中國利用外資銀行的階段。第二章將從準(zhǔn)入、運營和退出的三個階段比較中美兩國對外資銀行的監(jiān)管并對監(jiān)管立法、監(jiān)管機(jī)構(gòu)設(shè)置、監(jiān)管內(nèi)容方面的異同進(jìn)行較為詳細(xì)的論述。第三章將列舉國內(nèi)現(xiàn)存制度的不完善之處,并就如何進(jìn)一步修補(bǔ)提出了建議。
[Abstract]:Nowadays, the deep influence of the international financial crisis continues to appear, the world economy shows a downward trend, and the domestic economy enters the "new normal". In this case, in order to ensure the orderly flow of economic elements under the top-level strategic design, the efficient allocation of resources and the deep integration of the market, China's financial field needs to be further opened to the outside world, among which the opening of the banking industry to foreign investment is an important part. However, the banking industry, which has mastered the lifeblood of the national economy and financial economy, not only hinders the steady development of the financial sector, but also affects the normal operation of the national economy in case of poor management or management crisis. From the point of view of laws and regulations, it is of great significance to study the means of bank supervision and to standardize the banking industry through legal means to promote the healthy and steady development of the banking industry. The main content of this paper is divided into the following three parts. The first chapter analyzes the current situation of China's economy and the significance of foreign banks to China, compares the legislative process of the two countries with reference to the similar problems encountered by the United States in the process of economic development. Find out the stage of using foreign banks in China. The second chapter compares the supervision of foreign banks between China and the United States from the three stages of access, operation and withdrawal, and discusses in detail the similarities and differences of the regulatory legislation, the establishment of regulatory institutions, and the contents of supervision in China and the United States. The third chapter lists the imperfections of the existing system in China, and puts forward some suggestions on how to mend it further.
