【摘要】：隨著公務(wù)船市場的快速發(fā)展,現(xiàn)行公務(wù)船管理模式和制度已難以滿足現(xiàn)實的需要和形勢的變化,基于此背景,本文將對公務(wù)船在海上執(zhí)法過程中的武力使用管理、船員管理和技術(shù)管理三個方面的法律問題進(jìn)行深入研究,探索相應(yīng)的應(yīng)對措施,以期為我國科學(xué)化、專業(yè)化管理公務(wù)船貢獻(xiàn)自己的綿薄之力。本文共分為以下四個部分:在第一章中,闡述公務(wù)船管理中涉及公務(wù)船的基本法律理論。此部分從法律規(guī)定和學(xué)者兩個角度界定了公務(wù)船的內(nèi)涵,在此基礎(chǔ)上,明確本文下的公務(wù)船管理含義及具體范圍。在第二章中,公務(wù)船管理現(xiàn)狀探究。此部分從三個方面出發(fā),首先論證了公務(wù)船在海上執(zhí)法過程中武力使用的合法性,分析了我國現(xiàn)有公務(wù)船武力使用的法律依據(jù)和武器配備現(xiàn)狀;其次,研究了公務(wù)船船員在培訓(xùn)、考試發(fā)證、配員以及權(quán)益保障方面的立法現(xiàn)狀和用工模式現(xiàn)狀;最后,討論了公務(wù)船在防污染和安全管理方面的立法現(xiàn)狀及其防污措施和安全水平。在第三章中,公務(wù)船管理存在的法律問題探究。在對公務(wù)船管理現(xiàn)狀加以厘清的基礎(chǔ)上,此部分提出我國公務(wù)船武力使用依據(jù)不足和具體程序不明、現(xiàn)行公務(wù)船員培訓(xùn)、適任考試、配員規(guī)則等方面制度不符合需要以及公務(wù)船在防污染規(guī)定上存在局限性等法律問題。在第四章中,公務(wù)船管理應(yīng)對措施探究。此部分針對第三章提出的法律問題,從立法和管理模式兩個層面出發(fā),提出了完善公務(wù)船武力使用法律規(guī)范、制定公務(wù)船船員適任考試發(fā)證規(guī)則、修訂相關(guān)防污染規(guī)定以及引入第三方船員管理和技術(shù)管理等設(shè)想、思路和具體措施。
[Abstract]:With the rapid development of the official ship market, the current management mode and system of the official ship can not meet the needs of the reality and the change of the situation. Based on this background, this paper will manage the use of force in the course of the public ship law enforcement at sea. The legal problems of crew management and technical management are studied in depth and the corresponding countermeasures are explored in order to contribute to our country's scientific and professional management of official ships. This paper is divided into the following four parts: in the first chapter, the basic legal theory of official ship management is expounded. This part defines the connotation of official ship from two angles of law regulation and scholar. On this basis, it clarifies the meaning and concrete scope of the management of official ship under this article. In the second chapter, the current situation of the management of official ships is explored. This part starts from three aspects, first of all, demonstrates the legality of the use of force in the course of maritime law enforcement, analyzes the legal basis of the use of force and the present situation of weapon equipment of the existing official ships in China. The present situation of legislation and employment mode in the aspects of training, examination and certification, assignment and protection of rights and interests of the crew of official ships are studied. Finally, the present legislative situation of pollution prevention and safety management of official ships and the measures and safety level of pollution prevention are discussed. In the third chapter, the legal problems existing in the management of official ships are explored. On the basis of clarifying the present situation of the management of official ships, this part points out that the use of force on official ships in our country is based on insufficient basis and unclear concrete procedures, and the current official crew training, suitable examination, The rules of assignment and other aspects of the system do not meet the needs of the official ship pollution prevention regulations on the limitations of the legal problems. In the fourth chapter, the management measures of official ship are explored. In this part, according to the legal problems raised in the third chapter, from the two aspects of legislation and management mode, the author puts forward to perfect the legal norms of the use of force on official ships, and to formulate the rules of certification for the examination of the crew members of official ships. To revise the relevant pollution prevention regulations and introduce the third party crew management and technical management, ideas and specific measures.
