【摘要】：關(guān)于如何制定中國航天法,從國家政策定位講,既要落實中國航天政策與推動航天事業(yè)向縱深發(fā)展,又要推進(jìn)空間領(lǐng)域軍事與民用的深度融合;從法律專業(yè)定位講,應(yīng)體現(xiàn)公法與私法功能整合、實體法與程序法調(diào)控方式兼顧、國內(nèi)法與國際法有效銜接等三方面特征。本文對于如何盡快制定中國航天法,提出兩條路徑:一是積極推動航天法立項的進(jìn)一步升級;二是抓住主要癥結(jié),解決五個方面關(guān)鍵問題。結(jié)論是要積極推動中國航天白皮書確定的立法項目有所突破并取得明顯進(jìn)展。
[Abstract]:With regard to how to formulate China's space law, from the point of view of the state's policy orientation, it is necessary to implement China's space policy and promote the further development of the space industry, as well as to promote the deep integration of military and civil affairs in the space field. It should embody the function integration of public law and private law, the combination of substantive law and procedural law, and the effective connection between domestic law and international law. This paper puts forward two ways to formulate China's space law as soon as possible: one is to actively promote the further upgrading of space law, the other is to grasp the main crux of the problem and solve five key problems. The conclusion is that we should actively push forward the legislative project of China's Aerospace White Paper and make remarkable progress.
