【摘要】：實(shí)體法上規(guī)劃保證義務(wù)的缺失和責(zé)任機(jī)制的疏漏是立法范疇內(nèi)規(guī)劃赤字失范現(xiàn)象的癥結(jié)。我國(guó)既有的規(guī)劃保證義務(wù)立法結(jié)構(gòu)是國(guó)家《城鄉(xiāng)規(guī)劃法》保留程序性框架基本內(nèi)容,將實(shí)質(zhì)內(nèi)容下沉給部門特別法或地方立法填充,這一立法模式存在國(guó)家立法框架性指導(dǎo)空洞化和地方立法割據(jù)的結(jié)構(gòu)性問(wèn)題�！冻青l(xiāng)規(guī)劃法》作為國(guó)家立法,對(duì)規(guī)劃調(diào)整自由裁量的法定限制應(yīng)具有綱領(lǐng)性實(shí)質(zhì)內(nèi)容,通過(guò)對(duì)規(guī)劃保證義務(wù)實(shí)體標(biāo)準(zhǔn)核心要件的規(guī)定,實(shí)現(xiàn)從程序規(guī)制向?qū)嶓w規(guī)制的轉(zhuǎn)化。在國(guó)家立法與地方立法的關(guān)系問(wèn)題上,一種通過(guò)完善強(qiáng)制性位階審查制度,重點(diǎn)調(diào)整規(guī)劃保證義務(wù)立法結(jié)構(gòu)中"中央—地方"縱向關(guān)系;一種通過(guò)開創(chuàng)符合中國(guó)現(xiàn)實(shí)的城市更新地方示范法,側(cè)重調(diào)整規(guī)劃保證義務(wù)立法結(jié)構(gòu)中"地方—地方"橫向關(guān)系。兩種模式互補(bǔ)與互助的適用,將對(duì)規(guī)劃保證義務(wù)立法形成網(wǎng)格規(guī)制的理想結(jié)構(gòu)模型。
[Abstract]:The deficiency of planning guarantee obligation and the omission of responsibility mechanism in substantive law are the crux of the phenomenon of irregular planning deficit in the scope of legislation. The existing legislative structure of the obligation of planning guarantee in China is the basic content of the procedural framework retained by the National Urban and Rural Planning Law, which sinks the substantive content into the special law of the department or local legislation. This legislative model has the structural problems of the blank guidance of the national legislative framework and the separation of local legislation. As a national legislation, the statutory restrictions on the discretion of planning adjustment should have programmatic substance. The transformation from procedural regulation to substantive regulation is realized through the provision of the core elements of the substantive standard of the obligation of planning guarantee. On the question of the relationship between national legislation and local legislation, a kind of vertical relationship between "central and local" in the legislative structure of planning guarantee obligation should be adjusted by perfecting the compulsory rank examination system. A kind of local model law is updated by creating a city in line with the reality of China, focusing on adjusting the "local-local" horizontal relationship in the legislative structure of the planning guarantee obligation. The application of complementary and mutual assistance between the two modes will form the ideal structure model of grid regulation for the legislation of planning guarantee obligation.
