【摘要】：消費(fèi)者權(quán)益保護(hù)是公眾關(guān)心的熱點(diǎn)問(wèn)題,在市場(chǎng)經(jīng)濟(jì)條件下我們每個(gè)人都可能是消費(fèi)者,但是消費(fèi)者權(quán)益受到侵害的情形卻時(shí)有發(fā)生,在反壟斷領(lǐng)域消費(fèi)者權(quán)益也受到壟斷行為的波及。本文從反價(jià)格壟斷的視角來(lái)闡述在反壟斷領(lǐng)域如何保護(hù)消費(fèi)者權(quán)益,并且提出自己的完善路徑的構(gòu)想,期望自己的構(gòu)想能夠補(bǔ)充理論研究的某些空白、改善實(shí)踐中保護(hù)消費(fèi)者權(quán)益不力的現(xiàn)狀。論文主體由三個(gè)部分構(gòu)成:第一部分對(duì)本文的兩個(gè)關(guān)鍵詞即價(jià)格壟斷行為和消費(fèi)者權(quán)益的概念進(jìn)行論述,并且闡釋二者之間的關(guān)系,為下文的論述作鋪墊。第二部分主要內(nèi)容是分析反價(jià)格壟斷保護(hù)消費(fèi)者權(quán)益的原因。結(jié)合典型案例闡述反價(jià)格壟斷保護(hù)消費(fèi)者權(quán)益的必要性,并且分析消費(fèi)者權(quán)益受到價(jià)格壟斷侵害的原因,揭示立法、執(zhí)法與司法三個(gè)方面都存在不足,綜合導(dǎo)致消費(fèi)者權(quán)益受損。第三部分主要內(nèi)容是完善反價(jià)格壟斷保護(hù)消費(fèi)者權(quán)益的路徑。根據(jù)第二部分消費(fèi)者權(quán)益受到侵害的原因,借鑒有些國(guó)家成熟的反價(jià)格壟斷保護(hù)消費(fèi)者權(quán)益經(jīng)驗(yàn),在反價(jià)格壟斷立法、執(zhí)法與司法三個(gè)方面提出自己的構(gòu)想,希望完善保護(hù)消費(fèi)者權(quán)益的路徑。
[Abstract]:The protection of consumers' rights and interests is a hot issue of public concern. Under the condition of market economy, each of us may be consumers, but consumer rights and interests are violated from time to time. In the field of anti-monopoly consumer rights and interests are also affected by monopoly behavior. From the perspective of anti-price monopoly, this paper expounds how to protect the rights and interests of consumers in the field of anti-monopoly, and puts forward the idea of its own perfect path, hoping that its own ideas can supplement some gaps in theoretical research. To improve the practice of inadequate protection of consumer rights and interests of the current situation. The main body of the thesis is composed of three parts: the first part discusses the concept of price monopoly behavior and consumer rights and interests, and explains the relationship between them, which lays the groundwork for the following discussion. The second part is to analyze the reasons of anti-price monopoly to protect consumer's rights and interests. Combined with typical cases, this paper expounds the necessity of anti-price monopoly to protect consumers' rights and interests, and analyzes the reasons why consumers' rights and interests are infringed by price monopoly, and reveals that there are shortcomings in three aspects: legislation, law enforcement and judicature. The synthesis causes the consumer rights and interests to be damaged. The third part of the main content is to improve the anti-price monopoly to protect the rights and interests of consumers. According to the reason why consumer rights and interests were infringed on in the second part, and drawing on the mature anti-price monopoly experience of some countries to protect consumers' rights and interests, the author put forward his own idea in three aspects of anti-price monopoly legislation, law enforcement and judicature. Hope to improve the path to protect the rights and interests of consumers.
