【摘要】：隨著現(xiàn)代社會食品領(lǐng)域的快速發(fā)展，，食品安全監(jiān)管難題凸顯，政府機構(gòu)職能交叉、權(quán)力尋租等弊病導(dǎo)致監(jiān)管不力，市場主體追逐最大利潤的自然沖動無法得到引導(dǎo)和抑制，在市場和政府雙重失靈的背景下，世界各國紛紛引入第三方非政府組織——食品行業(yè)協(xié)會以構(gòu)建多元化的監(jiān)管體系，有效解決了這一問題。然而，我國食品行業(yè)協(xié)會起步晚，始終沒有獨立的法律地位,無法充分發(fā)揮對食品行業(yè)的指導(dǎo)和約束作用，因此，確立食品行業(yè)協(xié)會獨立的法律地位對我國食品安全問題乃至社會發(fā)展有著十分重要的意義。 本文運用文獻分析的研究方法闡述了行業(yè)協(xié)會與食品行業(yè)協(xié)會的基本理論，對食品行業(yè)協(xié)會的概念、職能作出界定，并對我國食品行業(yè)協(xié)會發(fā)展現(xiàn)狀進行實證分析，將食品行業(yè)協(xié)會當前存在的行政化嚴重、自治能力不足、法律法規(guī)空白問題進行詳細闡述，進而得出結(jié)論：確立食品行業(yè)協(xié)會的獨立法律地位是非常必要的。因為現(xiàn)代社會多元化利益需求的出現(xiàn)必然要求食品行業(yè)協(xié)會在社會管理中發(fā)揮越來越多的主體功能，從而改善市場和政府雙重失靈所帶來的社會發(fā)展困境，這種作用的發(fā)揮需要充分保障食品行業(yè)協(xié)會的中介性、自治性、非營利性特性，這必然需要確立起食品行業(yè)協(xié)會獨立的法律地位才能實現(xiàn)。 本文對上述方面一一展開論述后，對目前關(guān)于行業(yè)協(xié)會法律地位的幾種觀點作了介紹和分析，并從行業(yè)協(xié)會追求行業(yè)共同利益、維護社會公益及承擔社會責任的價值取向分析指出，行業(yè)協(xié)會應(yīng)是經(jīng)濟法主體，且應(yīng)作為具有獨立法律地位的經(jīng)濟法主體與市場、政府共同促進經(jīng)濟利益和社會公益的平衡發(fā)展。確立食品行業(yè)協(xié)會的獨立法律地位，建立理論共識是基礎(chǔ)，同時必須厘清食品行業(yè)協(xié)會與政府、市場的關(guān)系，從內(nèi)部機制建設(shè)和外部政府監(jiān)管兩方面積極推進食品行業(yè)協(xié)會自身改革，并加快推進行業(yè)協(xié)會法律體系建設(shè)及食品行業(yè)協(xié)會專門法與配套法規(guī)的立法工作，最終為我國食品行業(yè)協(xié)會確立起獨立的法律地位，使其能夠充分發(fā)揮職能，為我國食品行業(yè)的健康發(fā)展及公民社會的進步貢獻力量，也為我國社會組織的發(fā)展與改革提供有益參考。
[Abstract]:With the rapid development of the food field in modern society, the difficult problem of food safety supervision is prominent, the malady such as the overlapping of the functions of the government agencies and the power seeking for rent leads to the weak supervision, and the natural impulse of the market main body to pursue the maximum profit can not be guided and restrained. Under the background of double failure of market and government, food industry associations, a third-party non-governmental organization, have been introduced into the world to build a diversified regulatory system, which has effectively solved this problem. However, the food industry association of our country started late, has no independent legal status, can not give full play to the role of guidance and restraint to the food industry, therefore, It is of great significance to establish the independent legal status of the food industry association for the food safety problems and even the social development of our country. In this paper, the basic theories of industry association and food industry association are expounded by the method of literature analysis, the concept and function of food industry association are defined, and the development status of food industry association in China is analyzed empirically. This paper expounds in detail the existing problems of food industry association, such as serious administration, insufficient autonomy, blank laws and regulations, and draws the conclusion that it is very necessary to establish the independent legal status of food trade association. Because the emergence of diversified interest demand in modern society inevitably requires food industry associations to play more and more main functions in social management, thus improving the social development dilemma caused by the double failure of market and government. This role needs to fully protect the intermediary, autonomous, non-profit characteristics of food industry associations, which must establish the independent legal status of food industry associations can be realized. After discussing the above aspects one by one, this paper introduces and analyzes several views on the legal status of trade associations, and pursues the common interests of the industry from the trade associations. The analysis of the value orientation of maintaining social public welfare and undertaking social responsibility points out that the trade association should be the subject of economic law, and should be the subject and market of economic law with independent legal status. The government jointly promotes the balanced development of economic interests and social welfare. Establishing the independent legal status of the food industry association and establishing a theoretical consensus are the basis. At the same time, we must clarify the relationship between the food industry association and the government and the market. We should actively promote the reform of food industry associations from the aspects of internal mechanism construction and external government supervision, and speed up the construction of the legal system of trade associations and the legislative work of special laws and supporting regulations for food trade associations. Finally, it establishes an independent legal status for the food industry association of our country, enables it to give full play to its functions, and contributes to the healthy development of the food industry in China and the progress of civil society. It also provides a useful reference for the development and reform of social organization in our country.
