【摘要】：作為改革的“試驗(yàn)田”,自貿(mào)試驗(yàn)區(qū)肩負(fù)著我國在新時(shí)期加快政府職能轉(zhuǎn)變、促進(jìn)貿(mào)易和投資便利化、探索管理模式創(chuàng)新,為全面深化改革和擴(kuò)大開放積累新經(jīng)驗(yàn)、探索新途徑的重要使命,是國家戰(zhàn)略需要。自貿(mào)試驗(yàn)區(qū)的制度創(chuàng)新也為海關(guān)切實(shí)轉(zhuǎn)變政府職能,創(chuàng)新行政管理方式,深化行政體制改革提供了廣闊的天地。如何抓住這一重大的歷史機(jī)遇,全面深化海關(guān)改革,探索轉(zhuǎn)變管理職能,建立適應(yīng)自貿(mào)試驗(yàn)區(qū)建設(shè)發(fā)展的新型海關(guān)管理模式,形成可復(fù)制可推廣的改革成果,助推建立高水平的開放型經(jīng)濟(jì)新體制,成為當(dāng)前我們亟待解決的首要課題。自2013年9月,自貿(mào)試驗(yàn)區(qū)成立以來,海關(guān)共推出了31項(xiàng)監(jiān)管服務(wù)創(chuàng)新舉措。本文立足自貿(mào)試驗(yàn)區(qū)海關(guān)監(jiān)管服務(wù)措施改革的實(shí)施現(xiàn)狀,以行政法為觀察視角,從四個(gè)方面對自貿(mào)試驗(yàn)區(qū)海關(guān)監(jiān)管服務(wù)措施改革進(jìn)行了分析,第一部分闡述了自貿(mào)試驗(yàn)區(qū)海關(guān)監(jiān)管服務(wù)措施改革概況,介紹了自貿(mào)試驗(yàn)區(qū)定義、海關(guān)職能定位,對自貿(mào)區(qū)和保稅區(qū)進(jìn)行了比較,并分析論證了自貿(mào)試驗(yàn)區(qū)海關(guān)監(jiān)管服務(wù)措施改革的必要性;第二部分闡述了自貿(mào)試驗(yàn)區(qū)海關(guān)監(jiān)管服務(wù)措施改革現(xiàn)狀,介紹了自貿(mào)試驗(yàn)區(qū)海關(guān)監(jiān)管服務(wù)改革的具體措施及特點(diǎn),以及實(shí)際的實(shí)施效果;第三部分剖析了當(dāng)前自貿(mào)試驗(yàn)區(qū)海關(guān)監(jiān)管服務(wù)措施改革需要進(jìn)一步解決的問題,并對問題產(chǎn)生的原因進(jìn)行了分析;第四部分是對完善自貿(mào)試驗(yàn)區(qū)海關(guān)監(jiān)管服務(wù)措施改革提出了具體的意見和建議。本文力求通過這四個(gè)方面的探討為海關(guān)以及其他行政機(jī)關(guān)在轉(zhuǎn)型發(fā)展新時(shí)期有效推進(jìn)行政體制改革、建設(shè)法治型政府、服務(wù)型政府提供有益的借鑒。
[Abstract]:As the "experimental field" of reform, the free trade experimental area is shouldering the task of speeding up the transformation of government functions, promoting the facilitation of trade and investment, exploring the innovation of management mode, and accumulating new experience for deepening the reform and opening wider to the outside world in China in the new period. The important mission of exploring new ways is the need of national strategy. The system innovation of the free trade test area also provides a broad field for the customs to transform the government function, innovate the administrative management mode and deepen the reform of the administrative system. How to seize this important historical opportunity, deepen customs reform in an all-round way, explore the transformation of management functions, establish a new customs management model adapted to the construction and development of the free trade experimental area, and form replicable and popularized reform results. Promoting the establishment of a high-level open-economy new system has become the most urgent task for us. Since the establishment of the FTAZ in September 2013, Customs has launched 31 innovative regulatory services initiatives. Based on the current situation of the reform of the customs supervision service measures in the free trade test area, this paper analyzes the reform of the customs supervision service measures in the free trade test area from four aspects from the perspective of administrative law. The first part describes the general situation of the reform of customs supervision and service measures in the free trade test area, introduces the definition of the free trade test area, the orientation of the customs function, and makes a comparison between the free trade area and the free trade zone. The second part expounds the current situation of the reform of customs supervision and service measures, and introduces the specific measures and characteristics of the reform of customs supervision services in the free trade test area. The third part analyzes the problems that need to be solved further in the reform of customs supervision and service measures in the FTAZ, and analyzes the causes of the problems. The fourth part is to improve the reform of customs supervision and service measures in FTAZ. This paper tries to provide useful reference for customs and other administrative organs to effectively promote the reform of administrative system, build a government ruled by law and serve as a reference for customs and other administrative organs in the new period of transformation and development through the discussion of these four aspects.
