【摘要】：經(jīng)濟(jì)全球化對我國銀行金融安全帶來了巨大影響。資源的配置,資本的流動促使銀行業(yè)務(wù)繁重,要求我國銀行業(yè)多元化發(fā)展。銀行業(yè)在發(fā)展過程中,也帶來了巨大的影響。經(jīng)濟(jì)全球化給我國銀行帶來了那些沖擊呢?沖擊中的風(fēng)險,我國又怎樣預(yù)防與化解呢?在諸多問題中,我國現(xiàn)有的法律是否能保證金融安全呢?本文從經(jīng)濟(jì)全球化背景下對銀行業(yè)金融安全的影響著手,通過對國際機(jī)構(gòu)及典型國家有關(guān)銀行金融安全法律保障制度進(jìn)行對比分析,為我國銀行金融安全法律及保障制度提出可行的建議。全文共分為五個部分。第一部分為導(dǎo)論,講述了本文選題背景及意義、并從現(xiàn)在法律環(huán)境及制度進(jìn)行分析得出本文的論點(diǎn)。第二部分,針對經(jīng)濟(jì)全球化下銀行金融安全及法律保障方面予以概述,當(dāng)前經(jīng)濟(jì)環(huán)境下,對我國銀行現(xiàn)行的金融安全及法律保障的影響。第三部分,就我國銀行金融安全及法律保障的現(xiàn)狀進(jìn)行分析,尋其不足之處,提出后續(xù)改善方向與對策。第四部分,依目前發(fā)達(dá)國家銀行、國際間金融機(jī)構(gòu)為保障金融安全而制定的法律制度進(jìn)行比較與分析,總結(jié)其優(yōu)勢與劣勢,對比我國現(xiàn)行相關(guān)法律制度,提出我國銀行間法律應(yīng)予以改善的方向。第五部分,綜述經(jīng)濟(jì)全球化背景下我們銀行金融安全法律保障制度的不足,從立法、執(zhí)法、司法等方面予以建議。
[Abstract]:The economic globalization has brought enormous influence to the bank financial security of our country. The allocation of resources and the flow of capital make the banking business arduous and require the diversified development of China's banking industry. In the process of development, banking has also brought great influence. What impact has economic globalization brought to our banks? How to prevent and resolve the risk of impact in China? Among the many problems, can the existing laws of our country guarantee the financial security? From the background of economic globalization, this paper makes a comparative analysis of the legal guarantee system of banking financial security in international institutions and typical countries. Put forward the feasible suggestion for our country bank financial security law and safeguard system. The full text is divided into five parts. The first part is the introduction, which describes the background and significance of this topic, and draws the argument from the analysis of the current legal environment and system. The second part summarizes the bank financial security and legal security in the context of economic globalization and the impact on the current financial security and legal security of Chinese banks under the current economic environment. In the third part, the author analyzes the present situation of bank financial security and legal security in China, finds out its shortcomings, and puts forward the direction and countermeasures for further improvement. The fourth part, according to the current developed country banks, international financial institutions to ensure the financial security of the legal system to compare and analyze, summed up its strengths and weaknesses, compared with the current relevant legal system in China. The paper puts forward the direction of improving the interbank law in our country. The fifth part summarizes the deficiency of our bank's financial security legal guarantee system under the background of economic globalization, and gives some suggestions from the aspects of legislation, law enforcement, judicature and so on.
