【摘要】：互助原則是船東互助保賠制度的基本原則,其不僅貫穿和引領(lǐng)船東互助保賠的各項制度,還為船東互助保賠制度的完善提供理論支持。船東互助保賠制度存在法律適用混亂和保險監(jiān)管缺位等問題。這些問題的解決關(guān)鍵在于遵循互助原則、尊重船東意思自治的產(chǎn)物——會員先付條款,同時在特定情況下兼顧公共利益,例外地允許與之偏離;尊重船東所選擇的協(xié)會,在普遍對協(xié)會進(jìn)行保險監(jiān)管的同時,為協(xié)會制定與之相適應(yīng)的監(jiān)管標(biāo)準(zhǔn)。
[Abstract]:Mutual aid principle is the basic principle of shipowners' mutual protection and compensation system. It not only runs through and leads the shipowners' mutual protection and compensation system, but also provides theoretical support for the improvement of shipowners' mutual protection and compensation system. There are some problems in shipowner's mutual protection and compensation system, such as confusion of legal application and absence of insurance supervision. The key to resolving these problems lies in following the principle of mutual assistance, respecting the product of shipowner's autonomy-the member's advance payment clause, taking into account the public interest in certain circumstances, allowing deviations from it exceptionally, and respecting the association chosen by the shipowner, In the general insurance regulation of the association, the association set the corresponding regulatory standards.
