反壟斷法私人實施的源流與功能研究

【摘要】:英美法系法律經(jīng)濟(jì)學(xué)家將法律的實施界分為公共實施與私人實施兩種方式。反壟斷私人實施最早源于美國,《謝爾曼法》第7條之規(guī)定可被視為其源頭。在美國成功經(jīng)驗的推動下,越來越多的國家建立了反壟斷法私人實施制度。反壟斷私人實施可以彌補公共實施的不足,有利于克服反壟斷法的不確定性,它對受害人的直接補償還可促進(jìn)矯正正義的實現(xiàn),同時私人主體廣泛參與反壟斷法實施還是競爭文化培養(yǎng)和發(fā)展的助推器。
[Abstract]:The legal economists of Anglo-American law system divide the law enforcement into public enforcement and private enforcement. Antitrust private enforcement originated in the United States, and section 7 of the Sherman Act can be regarded as its source. Driven by American successful experience, more and more countries have established private enforcement system of anti-monopoly law. Anti-monopoly private implementation can make up for the deficiency of public implementation and overcome the uncertainty of anti-monopoly law. Its direct compensation to the victims can also promote the realization of corrective justice. At the same time, private subjects participate in the implementation of anti-monopoly law is also the booster of the cultivation and development of competitive culture.
