【摘要】：網(wǎng)約車的發(fā)展,便捷了民眾出行,提高了社會效率,形成諸多積極影響。但北京、上海、天津等地出臺的網(wǎng)約車管理實施細(xì)則存在不少問題,它們對人、車和價格都進(jìn)行了極為嚴(yán)苛的管制,卻忽視了市場和技術(shù)手段的內(nèi)在規(guī)律。某些規(guī)定明顯違反《憲法》,違反《行政許可法》等上位法。應(yīng)采取個案救濟(jì)、立法的合法性審查等方式進(jìn)一步完善網(wǎng)約車監(jiān)管規(guī)則。
[Abstract]:The development of ride-sharing has made it convenient for people to travel, improved social efficiency and formed many positive effects. However, Beijing, Shanghai, Tianjin and other places have a lot of problems in the implementation of the regulations for the management of ride-hailing. They impose extremely strict regulations on people, cars and prices, but ignore the inherent laws of the market and technological means. Some provisions are obviously in violation of the Constitution and the Administrative Licensing Law. We should adopt the method of case relief, lawmaking legality examination and so on to further perfect the regulation rules of ride-hailing.
