【摘要】：出租汽車牌照作為出租汽車經(jīng)營權的客體,一方面,與物權法上的財產(chǎn)或物同樣具有客觀實在性、稀缺性、特定性與可轉(zhuǎn)讓性等特征;另一方面,它又具有政府管制性、行政特許性與功能復合性等新的特征。針對出租汽車牌照這種財產(chǎn),政府管制性與行政特許性在功能、性質(zhì)、主體等方面存在明顯差異。正確理解出租汽車牌照的財產(chǎn)屬性,有助于強化出租汽車經(jīng)營權的理論基礎。
[Abstract]:As the object of the right to operate the taxi, the taxi license, on the one hand, has the characteristics of objective reality, scarcity, specificity and transferability as well as property or property in the property law. On the other hand, it has the new characteristics of government regulation, administrative concession and function compound. There are obvious differences between government regulation and administrative concession in function, nature and subject. The correct understanding of the property property of the taxi license is helpful to strengthen the theoretical basis of the management right of the taxi.
