【摘要】：廣西是旅游資源富集區(qū)卻不是旅游經(jīng)濟(jì)強(qiáng)區(qū),原因在于旅游資源開(kāi)發(fā)不合理,片面追求經(jīng)濟(jì)效益導(dǎo)致旅游資源受到破壞,生態(tài)環(huán)境惡化。本文認(rèn)為解決旅游資源破壞和旅游資源開(kāi)發(fā)不合理的有效手段是加強(qiáng)旅游資源的立法保護(hù),從立法角度遏制對(duì)旅游資源的破壞行為,規(guī)范旅游資源的開(kāi)發(fā)利用。本文以廣西地方立法研究為視角,結(jié)合廣西旅游資源開(kāi)發(fā)與保護(hù)現(xiàn)狀,通過(guò)對(duì)廣西旅游資源立法工作的理論和具體實(shí)踐進(jìn)行分析,探索解決廣西旅游資源立法問(wèn)題的路徑。本文從三個(gè)部分展開(kāi)論述：第一部分論述廣西旅游資源立法現(xiàn)狀,從地方性法規(guī)、政府規(guī)章、自治條例等方面總結(jié)了廣西旅游資源立法取得的成果,并對(duì)其中有代表性的三部立法進(jìn)行評(píng)析；第二部分分析廣西現(xiàn)有旅游資源立法存在的缺陷及成因；第三部分是廣西旅游資源的立法完善。針對(duì)廣西旅游資源立法缺陷提出立法保護(hù)構(gòu)想：立法理念方面,貫徹可持續(xù)發(fā)展原則,堅(jiān)持保護(hù)優(yōu)先地位,強(qiáng)化立法科學(xué)性；立法體系方面加強(qiáng)重點(diǎn)領(lǐng)域立法,以上位法為依據(jù)構(gòu)建完善的廣西旅游資源立法體系；立法內(nèi)容方面,豐富立法調(diào)整范圍,完善資金保障制度；立法技術(shù)方面,重視公眾參與,提高立法可行性。
[Abstract]:Guangxi is a rich area of tourism resources but not a strong area of tourism economy. The reason is that the exploitation of tourism resources is unreasonable and the one-sided pursuit of economic benefits leads to the destruction of tourism resources and the deterioration of ecological environment. This paper holds that the effective means to solve the damage of tourism resources and the unreasonable exploitation of tourism resources are to strengthen the legislative protection of tourism resources, to curb the destructive behavior of tourism resources from the angle of legislation, and to standardize the exploitation and utilization of tourism resources. From the perspective of the study of Guangxi local legislation and the present situation of the development and protection of Guangxi tourism resources, this paper analyzes the theory and practice of Guangxi tourism resources legislation, and explores the ways to solve the problems of Guangxi tourism resources legislation. This paper discusses from three parts: the first part discusses the current situation of Guangxi tourism resources legislation, summarizes the achievements of Guangxi tourism resources legislation from the local laws, government regulations, autonomous regulations, etc. The second part analyzes the defects and causes of Guangxi's existing legislation on tourism resources; the third part is the legislative perfection of Guangxi's tourism resources. In view of the legislative defects of Guangxi tourism resources, this paper puts forward the legislative protection ideas: carrying out the principle of sustainable development, insisting on the priority of protection, strengthening the scientific nature of legislation, strengthening the legislation in key areas in the legislative system, On the basis of epigyny law, we should construct a perfect legislative system of Guangxi tourism resources; enrich the scope of legislative adjustment and perfect the system of fund guarantee in the aspect of legislation content; in the aspect of legislative technology, attach importance to public participation and improve the feasibility of legislation.
