【摘要】：美國和歐盟的反壟斷法體系雖是其他國家和地區(qū)學(xué)習(xí)之模板,但也產(chǎn)生了反壟斷法制度是否適合所有規(guī)模經(jīng)濟(jì)體情況的問題。從經(jīng)濟(jì)學(xué)理論上說,小經(jīng)濟(jì)體因為更容易受到規(guī)模經(jīng)濟(jì)的影響,故需要在反壟斷法的并購控制、市場支配地位濫用等方面進(jìn)行制度調(diào)整。但是,小經(jīng)濟(jì)體本身的多樣性和現(xiàn)實狀況的復(fù)雜性卻對反壟斷法本身是否應(yīng)當(dāng)?shù)玫竭m用這一前提提出了挑戰(zhàn)。在澳門這樣一個開放型的小經(jīng)濟(jì)體中,盡管引入競爭促使其博彩業(yè)得以快速發(fā)展,消解了之前市場的壟斷格局,但外部需求的持續(xù)增長使得博彩業(yè)不斷擴(kuò)張,吸引了包括勞動力、土地在內(nèi)的稀缺資源進(jìn)入到博彩業(yè)中,導(dǎo)致產(chǎn)業(yè)單一化問題惡化,嚴(yán)重威脅到澳門經(jīng)濟(jì)的安全。對此情況,反壟斷法理論體系往往只考慮到開放競爭對于產(chǎn)業(yè)內(nèi)壟斷的抑制,而對產(chǎn)業(yè)間資源分配所導(dǎo)致的結(jié)果卻沒有考慮,使得反壟斷法制度本身并不能處理由此所產(chǎn)生的經(jīng)濟(jì)安全問題。在反壟斷法與其他社會政策發(fā)生沖突時,對經(jīng)濟(jì)安全的確保具有基礎(chǔ)性作用,必然會排斥反壟斷法的適用。
[Abstract]:Although the anti-monopoly law system of the United States and the European Union is a model for other countries and regions to learn, it also raises the question of whether the anti-monopoly law system is suitable for all economies. From the economic theory, because small economies are more vulnerable to the impact of economies of scale, it is necessary to adjust the system in the aspects of merger and acquisition control of anti-monopoly law, abuse of market dominant position, and so on. But the diversity of small economies and the complexity of reality challenge the premise that antitrust law itself should be applied. In a small open economy like Macao, although the introduction of competition has led to the rapid development of its gambling industry and eliminated the monopoly of the previous market, the continued growth of external demand has led to the constant expansion of the gambling industry. It has attracted scarce resources, including labor and land, into the gambling industry, exacerbating the problem of unifying the industry and seriously threatening the security of Macao's economy. In this case, the theoretical system of anti-monopoly law usually only considers the inhibition of open competition to intra-industry monopoly, but not the result of inter-industry resource allocation. This makes the anti-monopoly law itself not able to deal with the economic security problems arising therefrom. When the anti-monopoly law conflicts with other social policies, it plays a fundamental role in ensuring the economic security, and it will inevitably exclude the application of the anti-monopoly law.
