【摘要】:價(jià)格問題關(guān)系著千家萬(wàn)戶,關(guān)系著市場(chǎng)經(jīng)濟(jì)的穩(wěn)定和發(fā)展。價(jià)格監(jiān)管是市場(chǎng)監(jiān)管的重要內(nèi)容。隨著國(guó)家對(duì)商品價(jià)格的逐步放開以及價(jià)格改革的不斷深入,如何實(shí)現(xiàn)對(duì)市場(chǎng)價(jià)格及時(shí)有效、合理有度的監(jiān)管成為市場(chǎng)價(jià)格監(jiān)管工作的重點(diǎn)。價(jià)格約談是價(jià)格主管部門通過約請(qǐng)?zhí)囟ü、法人或其他組織談話來進(jìn)行提醒告誡的方式,是一種柔性的、事前性的、協(xié)商性的價(jià)格監(jiān)管方式。它是我國(guó)市場(chǎng)價(jià)格監(jiān)管工作中方式和手段的自主創(chuàng)新,在實(shí)踐中也越來越受到重用。但是我國(guó)價(jià)格約談的規(guī)范存在很多漏洞,具體的價(jià)格約談實(shí)踐也出現(xiàn)較多問題,這些漏洞和問題限制了價(jià)格約談優(yōu)勢(shì)和效用的發(fā)揮,甚至使得其本身的合理性、正當(dāng)性遭到質(zhì)疑。從制度的角度來說,目前我國(guó)尚未形成合理、完善的規(guī)范價(jià)格約談的制度。本文采用實(shí)證分析、比較分析、文獻(xiàn)分析多種研究方法相結(jié)合的方式,以制度化為落腳點(diǎn)對(duì)價(jià)格約談進(jìn)行深入研究。本文首先闡釋了價(jià)格約談的一般理論;其次考察了我國(guó)價(jià)格約談的規(guī)范和實(shí)踐兩方面的具體情況,指出我國(guó)價(jià)格約談面臨的現(xiàn)實(shí)困境,然后以制度化為切入點(diǎn),分析價(jià)格約談制度化的客觀基礎(chǔ),最后提出價(jià)格約談制度化的具體思路。本文除引言和結(jié)語(yǔ)外,共分為四部分,內(nèi)容如下:第一部分:價(jià)格約談的一般理論。該部分主要是從理論上分析價(jià)格約談,詮釋了價(jià)格約談的基本內(nèi)涵,分析了價(jià)格約談的性質(zhì),并深入剖析了價(jià)格約談的價(jià)值。第二部分:價(jià)格約談的現(xiàn)狀考察。該部分先介紹了我國(guó)價(jià)格約談的規(guī)范狀態(tài)和實(shí)施現(xiàn)狀,然后以此為基礎(chǔ),分析了我國(guó)價(jià)格約談所面臨的現(xiàn)實(shí)困境,指出在規(guī)范層面存在的規(guī)范效力層級(jí)低、具體規(guī)定散亂簡(jiǎn)單、程序性規(guī)定不全面、監(jiān)督救濟(jì)機(jī)制缺乏等問題,以及在具體實(shí)施中發(fā)生異化、缺乏透明性和公開性等問題問題是我國(guó)價(jià)格約談是我國(guó)價(jià)格約談面臨的主要困境。第三部分:價(jià)格約談制度化的客觀基礎(chǔ)。該部分首先對(duì)價(jià)格約談制度和價(jià)格約談制度化進(jìn)行定位,指出價(jià)格約談制度化是規(guī)范價(jià)格約談的法律制度不斷完善、成熟和發(fā)展的過程。然后闡述了價(jià)格約談制度化的必要性。最后采取比較分析的方法,分析了我國(guó)現(xiàn)在的稅務(wù)約談制度和食品藥品安全責(zé)任約談制度為價(jià)格約談制度化積累的經(jīng)驗(yàn)基礎(chǔ)。第四部分:價(jià)格約談制度化的基本思路。該部分是本文的中心和核心部分,結(jié)合我國(guó)價(jià)格約談面臨的現(xiàn)實(shí)困境,提出價(jià)格約談制度化的具體思路。一是提高價(jià)格約談的規(guī)范效力;二是確立價(jià)格約談的基本原則;三是完善價(jià)格約談的程序設(shè)置;四是構(gòu)建價(jià)格約談的監(jiān)督救濟(jì)機(jī)制。
[Abstract]:The question of price is related to thousands of households and the stability and development of market economy. Price regulation is an important part of market regulation. With the gradual liberalization of commodity prices and the deepening of price reform, how to realize timely and effective supervision of market prices has become the focus of market price supervision. Price interview is a kind of flexible, prior and negotiated way of price supervision by inviting specific citizens, legal persons or other organizations to talk. It is the independent innovation of the ways and means in the supervision of market price in our country, and is more and more reused in practice. However, there are many loopholes in the norms of price interview in our country, and there are many problems in the practice of price interview. These loopholes and problems restrict the advantage and utility of price interview, and even make it reasonable. The legitimacy was questioned. From the system point of view, our country has not formed a reasonable, perfect system of standardized price interview. In this paper, empirical analysis, comparative analysis, literature analysis of a variety of research methods combined, institutionalization as the foothold of the price interview in-depth study. This paper first explains the general theory of price interview, and then investigates the concrete situation of the norms and practice of price interview in our country, points out the realistic dilemma of price interview in China, and then takes institutionalization as the breakthrough point. This paper analyzes the objective basis of the institutionalization of price interview, and finally puts forward the concrete ideas of institutionalization of price interview. In addition to the introduction and conclusion, this paper is divided into four parts: the first part: the general theory of price interview. This part mainly analyzes the price interview theoretically, explains the basic connotation of the price interview, analyzes the nature of the price interview, and deeply analyzes the value of the price interview. The second part: the current situation of price interview. This part first introduces the standard status and implementation status of price interview in China, and then, based on this, analyzes the practical dilemma of price interview in China, points out that the normative level is low and the specific provisions are scattered and simple at the normative level. Such problems as incomplete procedural provisions, lack of supervision and relief mechanism, alienation in concrete implementation and lack of transparency and openness are the main difficulties faced by price interviews in China. The third part: the objective foundation of the institutionalization of price interview. In this part, the price interview system and the price interview institutionalization are defined, pointing out that the price interview institutionalization is the process of perfecting, maturing and developing the legal system of standardizing price interview. Then it expounds the necessity of institutionalization of price interview. Finally, by using the method of comparative analysis, this paper analyzes the empirical basis of the current tax interview system and the food and drug safety responsibility interview system for the systematization of price interview in our country. The fourth part: the basic idea of institutionalization of price interview. This part is the center and core part of this paper, combined with the realistic predicament of price interview in our country, puts forward the concrete thought of systematization of price interview. One is to improve the normative effectiveness of price interviews; the other is to establish the basic principles of price interviews; third, to improve the procedures of price interviews; fourth, to build a mechanism of supervision and relief for price interviews.
