【摘要】：《網(wǎng)絡(luò)預(yù)約出租汽車經(jīng)營服務(wù)管理暫行辦法》伊始就引起了社會的廣泛關(guān)注,尤其是各地紛紛制定網(wǎng)約車細(xì)則,門檻是否過高問題也引起了激烈討論。但無論結(jié)果如何,社會公眾在網(wǎng)約車平臺應(yīng)納入管理、承擔(dān)承運(yùn)人責(zé)任的問題上,大體達(dá)成共識。本文首先梳理了順風(fēng)車、專車、快車、出租車及代駕、試駕等網(wǎng)約車平臺業(yè)務(wù),并分別對比分析了其平臺承運(yùn)者或經(jīng)營者的民事責(zé)任,以期推動(dòng)我國網(wǎng)絡(luò)約車業(yè)務(wù)合法化、合理化運(yùn)營。對比分析網(wǎng)約車平臺經(jīng)營者應(yīng)承擔(dān)的民事責(zé)任,具有十分重要的現(xiàn)實(shí)意義。
[Abstract]:From the beginning, it has aroused widespread concern of the society, especially the local governments have drawn up the rules and regulations of the network, and the question of whether the threshold is too high has also aroused heated discussion. However, no matter what the result, the public generally reach a consensus on the issue that the ride-hailing platform should be brought into the management and bear the responsibility of the carrier. This paper first combs the network ride-hailing platform business, such as hailing car, special train, express train, taxi and substitute driving, test driving and so on, and compares and analyzes the civil liability of the carrier or operator of the platform respectively, in order to promote the legalization of the network ride-sharing business in our country. Rationalize operation. It is of great practical significance to compare and analyze the civil liability of the operators of the ride-hailing platform.
