【摘要】：PPP模式的本質(zhì)是政府與社會(huì)資本合作,實(shí)現(xiàn)利益共享、風(fēng)險(xiǎn)共擔(dān)、權(quán)責(zé)均衡。但實(shí)踐中由于缺乏基礎(chǔ)法律架構(gòu),未能形成有效的監(jiān)管體系,在PPP項(xiàng)目合作中政府角色錯(cuò)位、行政權(quán)力濫用、社會(huì)資本權(quán)益缺乏法律救濟(jì)等已成為阻礙我國(guó)PPP行業(yè)發(fā)展的主要因素。當(dāng)務(wù)之急是厘清政府雙重角色,完善政府風(fēng)險(xiǎn)分擔(dān)機(jī)制,規(guī)范政府權(quán)力合法行使,繼而保障PPP模式在我國(guó)的順利推進(jìn)。
[Abstract]:The essence of PPP model is the cooperation between government and social capital, the realization of benefit sharing, risk sharing and balance of power and responsibility. However, in practice, due to the lack of basic legal framework, an effective regulatory system has not been formed. In the PPP project cooperation, the role of the government is misplaced, and the administrative power is abused. The lack of legal remedy for social capital rights and interests has become the main factor hindering the development of PPP industry in China. The urgent task is to clarify the dual role of the government, perfect the mechanism of government risk sharing, standardize the legitimate exercise of government power, and then ensure the smooth progress of the PPP model in our country.
