【摘要】：近年來有關(guān)信息產(chǎn)業(yè)標準必要專利的反壟斷案件在全球范圍內(nèi)風起云涌,各國反壟斷執(zhí)法司法機構(gòu)亦就如何消除標準實施過程中可能產(chǎn)生的反競爭效果進行了有益探索。通過梳理華為訴美國IDC濫用標準必要專利壟斷案,微軟收購諾基亞經(jīng)營者集中審查以及國家發(fā)改委對高通公司的反壟斷調(diào)查,并與歐美有關(guān)實踐經(jīng)驗進行比較,可以初步總結(jié)出我國有權(quán)機關(guān)在此類案件中界定相關(guān)市場、認定市場支配地位的考查要點與論證進路。信息產(chǎn)業(yè)標準必要專利反壟斷法規(guī)制的中國邏輯符合世界邏輯之精華,又立足具體案情作出寶貴創(chuàng)新,反過來有利于世界邏輯之完善。
[Abstract]:In recent years, the antitrust cases related to the necessary patents in the information industry standards are surging in the global scope, and the judicial organs of the anti-monopoly law enforcement in various countries have also carried on the beneficial exploration on how to eliminate the anti-competitive effect that may be produced in the course of the implementation of the standards. By combing the case of Huawei v. the United States IDC regarding the abuse of the necessary patent monopoly of standards, Microsoft's acquisition of Nokia operators centralized review and the National Development and Reform Commission's antitrust investigation into Qualcomm, and compared with the relevant practical experience in Europe and the United States, We can preliminarily summarize the main points of examination and argumentation path of determining the dominant position of the market by defining the relevant market in this kind of cases by the competent organs in our country. The Chinese logic regulated by the patent antimonopoly law in the information industry standard accords with the essence of the world logic, and makes valuable innovations based on the concrete cases, which is beneficial to the perfection of the world logic.
