【摘要】:第三方支付伴隨著網(wǎng)絡(luò)交易而迅猛發(fā)展,因其便利性、經(jīng)濟(jì)性的特點(diǎn),受到廣大消費(fèi)者的青睞。但是其過(guò)快的發(fā)展速度也帶來(lái)了一系列問(wèn)題,其中消費(fèi)者權(quán)益保護(hù)問(wèn)題最為突出。因第三方支付高度虛擬性、專(zhuān)業(yè)性、技術(shù)性的特征,使得第三方支付中的消費(fèi)者處于弱勢(shì)地位,其風(fēng)險(xiǎn)防范能力比一般消費(fèi)者更弱。并且我國(guó)在第三方支付領(lǐng)域的立法明顯滯后,對(duì)于第三方支付中消費(fèi)者權(quán)益保護(hù)方面的規(guī)定十分零散且存在缺陷,對(duì)消費(fèi)者的個(gè)人信息安全、資金安全、知情權(quán)等都缺乏適當(dāng)保護(hù)。消費(fèi)者權(quán)益保護(hù)是第三方支付行業(yè)健康發(fā)展的中心環(huán)節(jié),落實(shí)消費(fèi)者權(quán)益保護(hù),才能保障第三方支付行業(yè)的長(zhǎng)遠(yuǎn)發(fā)展。本文通過(guò)分析第三方支付與消費(fèi)者之間的基礎(chǔ)關(guān)系,進(jìn)而結(jié)合實(shí)踐中消費(fèi)者權(quán)益受損的案例,深入探討我國(guó)在第三方支付消費(fèi)者權(quán)益保護(hù)方面存在的法律問(wèn)題,接著從美國(guó)和歐盟在消費(fèi)者權(quán)益保護(hù)方面的相關(guān)經(jīng)驗(yàn)得出啟發(fā),最后在立足我國(guó)國(guó)情的基礎(chǔ)上提出完善第三方支付中消費(fèi)者權(quán)益保護(hù)的具體措施。論文的主要框架如下:引言部分通過(guò)四個(gè)案例引出本文討論的問(wèn)題,并介紹了論文選題背景及研究意義、國(guó)內(nèi)外研究現(xiàn)狀和研究方法。第二部分對(duì)第三方支付和消費(fèi)者權(quán)益保護(hù)的必要性做了基本介紹。首先明確了本文對(duì)第三方支付的定義和研究對(duì)象,然后分析了第三方支付機(jī)構(gòu)與消費(fèi)者之間的法律關(guān)系,最后指出了第三方支付中消費(fèi)者權(quán)益面臨的風(fēng)險(xiǎn)和對(duì)其進(jìn)行保護(hù)的必要性。第三部分系統(tǒng)分析了我國(guó)第三方支付中消費(fèi)者權(quán)益保護(hù)存在的四大問(wèn)題,分別是:消費(fèi)者個(gè)人信息安全問(wèn)題、消費(fèi)者資金安全問(wèn)題、第三方支付機(jī)構(gòu)信息披露問(wèn)題和第三方支付糾紛解決問(wèn)題。第四部分針對(duì)我國(guó)第三方支付中消費(fèi)者權(quán)益保護(hù)存在的問(wèn)題,考察了美國(guó)和歐盟在這些方面的立法狀況,并總結(jié)其成功的立法經(jīng)驗(yàn)以及獲得的重要啟示。第五部分針對(duì)第三部分的四大問(wèn)題提出了具體的完善建議。在消費(fèi)者個(gè)人信息保護(hù)方面,應(yīng)制定統(tǒng)一的個(gè)人信息保護(hù)法來(lái)明確消費(fèi)者的個(gè)人信息權(quán)利、第三方支付機(jī)構(gòu)的信息保障義務(wù)和消費(fèi)者個(gè)人信息保護(hù)責(zé)任機(jī)制;在消費(fèi)者資金安全保護(hù)方面,應(yīng)建立消費(fèi)者保障險(xiǎn)與保障金制度,并明確備付金利息的歸屬以及完善支付差錯(cuò)處理程序;在支付服務(wù)信息披露方面,應(yīng)豐富信息披露的內(nèi)容和形式并加強(qiáng)對(duì)信息披露的監(jiān)管;在糾紛解決方面,應(yīng)明確管轄法院、實(shí)行舉證責(zé)任倒置和建立在線糾紛解決機(jī)制。
[Abstract]:With the rapid development of online transactions, third-party payment is favored by consumers because of its convenience and economy. However, its rapid development has also brought a series of problems, among which the protection of consumer rights and interests is the most prominent. Because of the highly fictitious, professional and technical characteristics of third-party payment, the consumers in third-party payment are in a weak position, and their risk prevention ability is weaker than that of ordinary consumers. And our legislation in the field of third-party payment is obviously lagging behind. The provisions on the protection of consumers' rights and interests in third-party payment are very fragmented and flawed, which are very safe for consumers' personal information and funds. The right to know lacks proper protection. The protection of consumers' rights and interests is the central link of the healthy development of the third-party payment industry. Only by implementing the protection of the rights and interests of consumers can the long-term development of the third-party payment industry be guaranteed. By analyzing the basic relationship between third-party payment and consumers, and combining with the case of consumers' rights and interests in practice, this paper probes into the legal problems existing in the protection of the rights and interests of third-party payment consumers in China. Then it draws inspiration from the relevant experiences of the United States and the European Union in the protection of consumer rights and interests, and finally puts forward specific measures to improve the protection of consumer rights and interests in third-party payment on the basis of China's national conditions. The main framework of the paper is as follows: the introduction part leads to the problems discussed in this paper through four cases, and introduces the background and significance of the topic, the current research situation and research methods at home and abroad. The second part introduces the necessity of third-party payment and consumer protection. Firstly, the definition and research object of third-party payment are defined, and then the legal relationship between third-party payment organization and consumers is analyzed. Finally, the paper points out the risks faced by consumers in third-party payment and the necessity of protecting them. The third part systematically analyzes the four problems existing in the protection of consumer's rights and interests in third-party payment in China, which are: consumer personal information security, consumer financial security. Third-party payment agency information disclosure and third-party payment dispute resolution problem. In the fourth part, aiming at the problems existing in the protection of consumer rights and interests in third-party payment in China, the author reviews the legislative situation of the United States and the European Union in these aspects, and summarizes its successful legislative experience and important enlightenment. The fifth part puts forward specific suggestions for the four problems in the third part. In the aspect of consumer personal information protection, it is necessary to establish a unified personal information protection law to clarify consumers' personal information rights, the information protection obligations of third-party payment agencies and the mechanism of consumers' personal information protection responsibility. With regard to the safety protection of consumer funds, we should establish a system of consumer protection insurance and protection benefits, make clear the attribution of interest on reserve payments and improve the procedures for handling payment errors; in terms of disclosure of payment service information, The contents and forms of information disclosure should be enriched and the supervision of information disclosure should be strengthened. In the aspect of dispute resolution, the court should be clearly regulated, the burden of proof should be reversed and the online dispute resolution mechanism should be established.
