【摘要】：在進(jìn)出口貿(mào)易日益繁榮的背景下,海上預(yù)約保險合同憑借簡捷、便利的優(yōu)點(diǎn)在海上保險實(shí)務(wù)中應(yīng)用得愈加廣泛。被保險人的申報義務(wù)在預(yù)約保險合同中十分重要,它直接影響到保險人是否承擔(dān)賠償責(zé)任。它是海上預(yù)約保險合同區(qū)別于普通保險合同之所在。時至今日,我國法律中只有《海商法》第231條至第233條對預(yù)約保險合同做出了簡略規(guī)定,且僅在第233條提及到了被保險人申報義務(wù)。學(xué)界在被保險人申報義務(wù)一些相關(guān)問題的討論中也并未形成一致觀點(diǎn)。保險實(shí)務(wù)中,不同保險公司的預(yù)約保險合同條款也并不統(tǒng)一,一些約定條款的內(nèi)容已偏離了預(yù)約保險合同的性質(zhì)及宗旨。但由于相關(guān)立法缺失,不能及時有效地給予規(guī)范矯正,導(dǎo)致爭議不斷,妨礙了海上貿(mào)易發(fā)展。一些法院在審理相關(guān)爭議糾紛時也遇到了法律適用上的問題。本文旨在就預(yù)約保險合同中被保險人申報義務(wù)若干問題加以探討,以期為完善我國海上預(yù)約保險合同中被保險人申報義務(wù)相關(guān)法律制度提出一些可行性建議。以此規(guī)范保險業(yè)務(wù),更好地解決爭議糾紛,讓預(yù)約保險合同制度在海上保險領(lǐng)域發(fā)揮出其應(yīng)有優(yōu)勢。
[Abstract]:Under the background of increasing prosperity of import and export trade, marine precontract insurance contract is more and more widely used in marine insurance practice by virtue of its advantages of simplicity and convenience. The insurant's declaration obligation is very important in the appointment insurance contract, it directly affects whether the insurer undertakes the compensation liability. It is the difference between a marine contract of insurance and an ordinary contract of insurance. Up to now, only articles 231 to 233 of the Maritime Law of our country have made a brief stipulation on the contract of advance insurance, and only mentioned the obligation of the insured to declare in the article 233. Academic circles in the insurant declaration obligations of some related issues in the discussion did not form a consensus point of view. In insurance practice, the terms of appointment insurance contract of different insurance companies are not uniform, and the contents of some agreement clauses have deviated from the nature and purpose of the appointment insurance contract. However, due to the lack of relevant legislation, it can not be corrected in time and effectively, which leads to disputes and hinders the development of maritime trade. Some courts have also encountered problems in the application of the law. The purpose of this paper is to discuss some problems of the insurant's obligation to declare in the contract of advance insurance, in order to put forward some feasible suggestions for perfecting the relevant legal system of the insurant's obligation of declaration in the contract of marine appointment insurance in China. In order to standardize insurance business, better resolve disputes, let the advance insurance contract system play its due advantage in marine insurance field.
