【摘要】：研究目的:本文分析鐵道部撤銷、政企分開后原鐵道部建設(shè)法規(guī)文件現(xiàn)狀,探討鐵路建設(shè)法規(guī)體系調(diào)整方案,進(jìn)而提出轉(zhuǎn)型期鐵路建設(shè)行業(yè)法規(guī)體系構(gòu)建建議。研究結(jié)論:(1)廣義鐵路建設(shè)法規(guī)體系中法律、行政法規(guī)文件不存在調(diào)整和變動,需要調(diào)整的是由原鐵道部頒布的有關(guān)規(guī)章和規(guī)范性文件;(2)截至2013年3月政企分開之時,原鐵道部有效建設(shè)法規(guī)文件共112個。按照職能進(jìn)行分類統(tǒng)計,其中23個屬于政府職能文件,62個屬于企業(yè)職能文件,27個兼有政府和企業(yè)職能的文件;(3)建議鐵路建設(shè)法規(guī)文件處理按照職能進(jìn)行拆分,中國鐵路總公司以企業(yè)職能文件為主構(gòu)建企業(yè)內(nèi)部規(guī)章制度體系,國家鐵路局以政府職能文件為主構(gòu)建政府建設(shè)法規(guī)體系;(4)建議國家鐵路局構(gòu)建包含工程建設(shè)標(biāo)準(zhǔn)和造價標(biāo)準(zhǔn)在內(nèi)的建設(shè)法規(guī)體系新框架,注意強化質(zhì)量、安全、招標(biāo)投標(biāo)、市場管理等法定職責(zé),并考慮投資主體多元化背景下政策的連續(xù)性和適用性;(5)本研究成果應(yīng)用領(lǐng)域為建設(shè)管理領(lǐng)域,可為國家鐵路局建立建設(shè)法規(guī)體系提供參考。
[Abstract]:The purpose of this paper is to analyze the present situation of the construction regulations of the former Ministry of Railways after the abolition of the Ministry of Railways and the separation of the government from the enterprises, to discuss the adjustment scheme of the regulations system of railway construction, and to put forward some suggestions for the construction of the legal system of the railway construction industry in Conclusion: (1) there is no adjustment or change in the laws and administrative regulations in the general railway construction law system, but the relevant regulations and normative documents issued by the former Ministry of Railways need to be adjusted.) until March 2013, when the government and enterprises were separated from each other, the relevant regulations and normative documents issued by the former Ministry of Railways were in need of adjustment. According to the classification of functions, 23 of them belong to government functional documents, 62 to enterprise functional documents, 27 to government and enterprise functions.) it is suggested that railway construction laws and regulations should be separated according to their functions. The China Railway Corporation builds the internal system of rules and regulations of the enterprise based on the functional documents of the enterprise. The State Administration of Railways, based on government function documents, proposes that the State Administration of Railways should construct a new framework of construction laws and regulations, including engineering construction standards and cost standards, and pay attention to strengthening quality, safety, bidding and bidding. Legal responsibilities such as market management, and considering the continuity and applicability of policy under the background of diversification of investment subjects.) the application field of this research results is the field of construction management, which can provide a reference for the establishment of construction laws and regulations system by the State Railway Administration.
