新疆巴克圖口岸農(nóng)產(chǎn)品貿(mào)易的法律問題研究

【摘要】:在歷史上,新疆借古“絲綢之路”與中亞、西亞和南亞以及歐洲各國的經(jīng)濟、文化往來密切,并逐步發(fā)展成為我國對外貿(mào)易的西部通道,而且它的一些邊境城市也變成了重要的通商口岸。從上世紀九十年代以來,中國與中亞五國的貿(mào)易日益活躍,特別是哈薩克斯坦作為中亞第一大國,基于毗鄰我國新疆的地域優(yōu)勢,中哈經(jīng)貿(mào)往來顯得更為頻繁。而2013年9月,我國國家主席習近平在出訪中亞國家時提出的共建絲綢之路經(jīng)濟帶這一偉大戰(zhàn)略,不僅將新疆放在了中國向西開放的橋頭堡地位,也突出了新疆的邊境口岸作為新亞歐大陸橋以及絲綢之路經(jīng)濟帶上中國聯(lián)結(jié)亞歐國家咽喉要地的重要性。新疆是農(nóng)業(yè)大省,一直以來農(nóng)產(chǎn)品也是位于新疆塔城地區(qū)的巴克圖口岸過貨量較大的商品。2013年12月23日,我國與陸上鄰國建立的第一個農(nóng)產(chǎn)品“綠色通道”,即中國與哈薩克斯坦之間的巴克圖-巴克特口岸農(nóng)產(chǎn)品快速通關(guān)的“綠色通道”正式開啟了。在新時期,為了保障絲綢之路經(jīng)濟帶上國際農(nóng)產(chǎn)品貿(mào)易的便利化推進,不僅要充分發(fā)揮新疆口岸在中哈農(nóng)產(chǎn)品貿(mào)易中的樞紐作用,而且必須優(yōu)先重視新疆口岸農(nóng)產(chǎn)品貿(mào)易的法律問題。因此,本文對開通綠色通道的巴克圖口岸農(nóng)產(chǎn)品貿(mào)易的法律問題研究在這時顯得尤為重要,其研究成果也將對絲綢之路經(jīng)濟帶上的其他國家和地區(qū)促進邊境口岸農(nóng)產(chǎn)品貿(mào)易的便利化發(fā)展有著十分重大的意義。本文主要包含三部分內(nèi)容,第一部分:介紹了新疆巴克圖口岸農(nóng)產(chǎn)品貿(mào)易的基本概況,包括口岸農(nóng)產(chǎn)品貿(mào)易概述、巴克圖口岸農(nóng)產(chǎn)品貿(mào)易的發(fā)展現(xiàn)狀以及巴克圖口岸發(fā)展農(nóng)產(chǎn)品貿(mào)易的區(qū)位優(yōu)勢。第二部分:詳細分析了新疆巴克圖口岸農(nóng)產(chǎn)品貿(mào)易中所涉及的法律問題,主要有中哈間貿(mào)易合作協(xié)議現(xiàn)狀、巴克圖口岸農(nóng)產(chǎn)品監(jiān)管環(huán)節(jié)的問題。第三部分:針對以上部分所發(fā)現(xiàn)的問題,對促進新疆巴克圖口岸農(nóng)產(chǎn)品貿(mào)易更加便利化發(fā)展提出了一些法律建議,如健全促進巴克圖口岸農(nóng)產(chǎn)品貿(mào)易更加便利化的相關(guān)制度、完善新疆巴克圖口岸農(nóng)產(chǎn)品貿(mào)易中的監(jiān)管法律問題、移植其它口岸的優(yōu)惠政策惠及巴克圖口岸等具體的相關(guān)建議。
[Abstract]:Historically, Xinjiang had close economic and cultural exchanges with countries in Central Asia, West and South Asia and Europe through the ancient "Silk Road," and gradually developed into a western corridor for China's foreign trade. And some of its border cities have become important trade ports. Since the 1990s, the trade between China and the five Central Asian countries has become more and more active, especially Kazakhstan, as the largest country in Central Asia, because of its regional advantages adjacent to Xinjiang, the economic and trade exchanges between China and Kazakhstan have become more frequent. In September 2013, when visiting Central Asian countries, Chinese President Xi Jinping put forward the great strategy of jointly constructing the Silk Road Economic Belt, which not only placed Xinjiang as a bridgehead for China to open to the west. It also highlights the importance of Xinjiang's border ports as a new Eurasian continental bridge and a vital place for China to connect the countries of Asia and Europe on the Silk Road economic belt. Xinjiang is a big agricultural province, and agricultural products have long been the largest commodity in the Bhaktu Port in the Tacheng region of Xinjiang. On December 23, 2013, China established the first "green passage" of agricultural products with its neighbors on land. That is, China and Kazakhstan between the Baktu-Bakert Port agricultural products rapid clearance of the "green channel" officially opened. In the new era, in order to ensure the facilitation of international agricultural trade in the Silk Road economic belt, not only should Xinjiang ports play a pivotal role in the trade of agricultural products between China and Kazakhstan, Moreover, priority must be given to the legal issues of agricultural trade at Xinjiang ports. Therefore, at this time, it is particularly important for this article to study the legal issues of agricultural trade at Barktu Port, which has opened a green channel. The research results will also be of great significance to other countries and regions on the Silk Road economic belt to promote the facilitation development of agricultural products trade at border ports. This paper mainly includes three parts. The first part introduces the basic situation of agricultural products trade at Bak Tu port in Xinjiang, including the overview of agricultural products trade in ports. The present situation of agricultural products trade in Barktu Port and the location advantage of Barktu Port in developing Agricultural products Trade. The second part: detailed analysis of the Xinjiang Barktu port agricultural products trade involved in the legal issues, mainly the current situation of Sino-Kazakh trade cooperation agreement, Barktu port agricultural products supervision issues. The third part: in view of the problems found in the above parts, the author puts forward some legal suggestions to promote the facilitation of agricultural products trade at Bak Tu Port in Xinjiang, such as perfecting the relevant system to promote the facilitation of agricultural products trade at Barktu Port. To perfect the supervision and legal problems in the agricultural products trade of Xinjiang Baku Port, and to transplant the preferential policies of other ports to benefit the Barktu Port and other specific relevant suggestions.
