【摘要】："一帶一路"為中國企業(yè)和資本走出國門創(chuàng)造了大量機(jī)會,也蘊(yùn)藏環(huán)境風(fēng)險。"一帶一路"沿線國家環(huán)境法治狀況參差多元、境外投資經(jīng)營也面臨諸多風(fēng)險,中資企業(yè)境外環(huán)境行為法律規(guī)制的確立不僅可以以身作則,向全世界表明推動綠色發(fā)展的決心,也可以為"一帶一路"建設(shè)提供良好的制度保障。當(dāng)前中資企業(yè)境外環(huán)境行為法律規(guī)制主要存在法律文件層級較低、以倡導(dǎo)性原則為主、內(nèi)容籠統(tǒng)、涉及領(lǐng)域狹窄等問題,在"一帶一路"倡議全面推進(jìn)實(shí)施的大背景下,本文提出在法律層面確立正式淵源,提升效力層級;制定體現(xiàn)國內(nèi)法補(bǔ)充適用的兜底條款;建設(shè)綜合性行政法規(guī);充分發(fā)揮部委和地方立法權(quán),因事、因地發(fā)揮部門規(guī)章和地方立法作用;拓展法學(xué)視野,加強(qiáng)與沿線國家合作與交流等。
[Abstract]:Belt and Road creates a lot of opportunities and environmental risks for Chinese enterprises and capital to go abroad. "The environmental rule of law in the countries along the route by Belt and Road is varied and diverse, and overseas investment and management are also facing many risks. The establishment of legal regulations on overseas environmental behavior of Chinese enterprises can not only lead by example, but also demonstrate to the whole world the determination to promote green development.Also can provide good system safeguard for "Belt and Road" construction.At present, the legal regulation of overseas environmental behavior of Chinese enterprises mainly exists in the lower level of legal documents, mainly based on the principle of advocacy, general content, narrow field and other issues. Under the background of "Belt and Road" proposal to comprehensively promote the implementation,This paper proposes to establish formal sources at the legal level, to enhance the level of effectiveness; to formulate provisions that reflect the supplementary application of domestic law; to build comprehensive administrative laws and regulations; to give full play to the legislative power of ministries and local governments;To play the role of department regulations and local legislation, expand the legal field of vision, strengthen cooperation and exchange with the countries along the line, etc.
