【摘要】:出租車行業(yè)監(jiān)管是指對出租車行業(yè)有監(jiān)督管理職責(zé)的主體為保障出租車行業(yè)的良好正常運(yùn)轉(zhuǎn)而對其采取的控制和調(diào)節(jié)行為。其具有地域性、強(qiáng)制性和反復(fù)性的特點(diǎn)。出租車行業(yè)監(jiān)管應(yīng)以追求法律意義的公平正義為價值目標(biāo)。我國出租車行業(yè)長期實(shí)行特許經(jīng)營,由于政府嚴(yán)格管控出租車的總量,出租車市場出現(xiàn)了供求失衡的局面。各地“出租車罷運(yùn)”事件就是這種嚴(yán)格監(jiān)管造成的種種矛盾的爆發(fā)。經(jīng)歷了長達(dá)六七年的呼吁、探討,2015年,政府終于下決心開始改革。但是出租車改革涉及多方利益,依然面臨很大阻礙。如何減輕政府干預(yù),促使網(wǎng)約車合法化,成為了改革的重點(diǎn)和難點(diǎn)。這些問題的根源,在于出租車行業(yè)監(jiān)管法律體系不完善。當(dāng)前,出租車行業(yè)監(jiān)管已有不少的法律法規(guī),尤其是地方性法規(guī),為監(jiān)管的具體操作提供了一定的法律依據(jù),實(shí)際運(yùn)行狀況也在隨著出租車市場的發(fā)展不斷調(diào)整。但是我國出租車行業(yè)監(jiān)管還存在很多法律問題,包括出租車行業(yè)監(jiān)管統(tǒng)一立法缺位、監(jiān)管主體權(quán)責(zé)失衡、網(wǎng)約車監(jiān)管內(nèi)容尚未明確、行業(yè)自律監(jiān)管體制不健全等。如今,很多發(fā)達(dá)國家和地區(qū)都已經(jīng)摸索到了適合自己國情的監(jiān)管方法,如統(tǒng)一監(jiān)管法律、創(chuàng)新和包容的監(jiān)管理念、加強(qiáng)行業(yè)自律監(jiān)管、適當(dāng)減少政府干預(yù)等。這些都為現(xiàn)階段我國出租車行業(yè)監(jiān)管改革提供了有益借鑒。立足現(xiàn)實(shí),借鑒域外,為完善出租車行業(yè)監(jiān)管,我國應(yīng)統(tǒng)一出租車行業(yè)監(jiān)管的立法,平衡政府在傳統(tǒng)出租車監(jiān)管中的權(quán)責(zé),明確網(wǎng)約車監(jiān)管內(nèi)容,健全出租車行業(yè)自律監(jiān)管體制。
[Abstract]:The taxi industry regulation is supervised control refers to the main body of the taxi industry management responsibilities to protect the normal operation of the taxi industry and the regulation and behavior. It has regional characteristics, mandatory and repeatable. The taxi industry regulation should be in pursuit of fairness and justice of the legal meaning of the value target. The implementation of the taxi industry in our country the franchise for a long period of time, due to the amount of government strict control of the taxi, the taxi market imbalance between supply and demand situation. Around the taxi strike event is the strict supervision of all sorts of contradictions caused by the outbreak. How to reduce government intervention, promote the network about cars legalization, become the focus and difficulty of reform. These The root of the problem lies in the taxi industry supervision legal system is not perfect. At present, the taxi industry regulation has a lot of laws and regulations, especially local regulations, provides the legal basis for the specific operation of supervision, the actual operation situation in the continuous adjustment of the development of the taxi market. But China's taxi industry regulation still exists many legal issues, including the taxi industry regulation legislation vacancy, supervision of the main responsibility imbalance, network supervision content about the car is not yet clear, self regulatory system is not perfect. Now, many developed countries and regions have worked to regulatory methods suited to its national conditions, such as unified legal supervision, innovation and inclusive concept of supervision to strengthen self-discipline, supervision, appropriate to reduce government intervention and so on. These are for the present stage of regulatory reform of the taxi industry in our country has provided the beneficial reference based. In reality, drawing lessons from abroad, in order to improve the supervision of taxi industry, we should unify the legislation of taxi industry regulation, balance the responsibilities and responsibilities of the government in the traditional taxi supervision, clarify the content of the supervision of the online car and improve the self regulatory system of the taxi industry.
