【摘要】：隨著我國市場經(jīng)濟(jì)的深入發(fā)展,社會(huì)財(cái)富與個(gè)人財(cái)富隨之進(jìn)一步積累,催生了日益增長的金融需求需要與滿足不同層次需求的各類金融產(chǎn)品,金融消費(fèi)者已在現(xiàn)代金融中扮演著重要的角色。然而,當(dāng)前中國的現(xiàn)行立法并沒有從制度上保障金融消費(fèi)者的權(quán)益。特別是面對(duì)日益增多的金融機(jī)構(gòu)與金融消費(fèi)者之間的金融糾紛,如何快捷有效地解決糾紛,切實(shí)保護(hù)金融消費(fèi)者權(quán)益的問題顯得十分迫切。金融申訴專員制度是域外建立金融消費(fèi)者糾紛處理機(jī)制方面的一種獨(dú)特制度,在解決金融糾紛方面具有獨(dú)特制度優(yōu)勢。因此,在我國引入該制度對(duì)于完善我國多元化糾紛解決機(jī)制,有著重要的參考借鑒意義。本文除引言和結(jié)語外,共分為四章。第一章對(duì)金融申訴專員制度的基本理論問題進(jìn)行界定和分析,包括金融申訴專員制度的內(nèi)涵、特征和外延的考察。第二章是對(duì)關(guān)于構(gòu)建我國金融申訴專員制度的必要性和可行性問題進(jìn)行研究和分析。第三章是對(duì)域外國家及地區(qū)(包括英國,澳大利亞,新加坡,臺(tái)灣,香港)的金融申訴專員制度進(jìn)行考究,并提出建立我國金融申訴專員制度的建議。第四章是通過學(xué)習(xí)和借鑒域外金融申訴專員制度的經(jīng)驗(yàn)做法,結(jié)合我國的具體國情,提出了構(gòu)建我國金融申訴專員制度的若干建議。
[Abstract]:With the further development of market economy in our country, social wealth and personal wealth have been further accumulated, which has given birth to increasing financial demand and various kinds of financial products to meet different levels of demand.Financial consumers have played an important role in modern finance.However, China's current legislation does not protect the rights and interests of financial consumers from the system.Especially in the face of more and more financial disputes between financial institutions and financial consumers, it is urgent to solve the disputes quickly and effectively and protect the rights and interests of financial consumers.The Financial Complaints Commissioner system is a kind of unique system in setting up financial consumer dispute handling mechanism, which has unique system advantages in resolving financial disputes.Therefore, the introduction of this system in our country has important reference significance for perfecting the diversified dispute resolution mechanism in our country.In addition to the introduction and conclusion, this article is divided into four chapters.The first chapter defines and analyzes the basic theoretical problems of the financial ombudsman system, including the connotation, characteristics and extension of the financial ombudsman system.The second chapter studies and analyzes the necessity and feasibility of constructing the financial complaints commissioner system in China.The third chapter studies the financial ombudsman system of foreign countries and regions (including Britain, Australia, Singapore, Taiwan, Hong Kong), and puts forward some suggestions to establish the financial ombudsman system in our country.In the fourth chapter, by studying and drawing lessons from the experience and practice of the foreign financial ombudsman system and combining the specific conditions of our country, the author puts forward some suggestions on the construction of the financial complaints commissioner system in our country.
