【摘要】：隨著網(wǎng)絡(luò)科技的高速發(fā)展以及智能手機(jī)的普及,網(wǎng)約車以其方便、舒適、快捷的運(yùn)營特點(diǎn)深受廣大消費(fèi)群體的喜愛,成為時(shí)下最為流行的居民出行方式。網(wǎng)約車發(fā)展之所以能夠如此迅速,主要得益于共享經(jīng)濟(jì)在全球范圍內(nèi)的興起和“互聯(lián)網(wǎng)+”背景下信息交流的便利。共享經(jīng)濟(jì)理論為網(wǎng)約車服務(wù)的發(fā)展提供了理論支撐,互聯(lián)網(wǎng)背景下信息溝通的便捷降低了社會信息交換的成本,網(wǎng)約車服務(wù)就是在這樣的環(huán)境下應(yīng)運(yùn)而生。我國網(wǎng)約車服務(wù)起步相對較晚,但發(fā)展勢頭迅猛,涌現(xiàn)出滴滴出行、神州專車等一系列成功的網(wǎng)約車服務(wù)平臺,網(wǎng)約車服務(wù)改變了傳統(tǒng)出行方式,給人們的日常生活帶來了極大的便利。但同時(shí),在網(wǎng)約車服務(wù)的發(fā)展過程中也產(chǎn)生了許多新的問題,乘坐網(wǎng)約車引發(fā)的安全事件時(shí)有發(fā)生,網(wǎng)約車服務(wù)安全系數(shù)令人堪憂。網(wǎng)約車交通事故理賠無門,消費(fèi)者面對推脫責(zé)任的各方束手無策。網(wǎng)約車服務(wù)多方參與,稅收征收稅種確定也成為稅務(wù)工作的一大難題等等。鑒于此,政府開始加強(qiáng)對網(wǎng)約車服務(wù)的管理和規(guī)制,但是由于沒有一個(gè)統(tǒng)一明確的規(guī)定,各地政府各自為政,對于網(wǎng)約車服務(wù)的規(guī)制難以跳出傳統(tǒng)出租車的管理模式,并未達(dá)到預(yù)期的目的。如何對新型網(wǎng)約車服務(wù)進(jìn)行法律規(guī)制,既保證其健康發(fā)展,又克服其自身問題,成為了擺在我們面前刻不容緩的問題。本文選取滴滴出行網(wǎng)約車服務(wù)平臺為觀察視角,探究網(wǎng)約車服務(wù)的發(fā)展概況、性質(zhì)、運(yùn)營模式,深入分析共享經(jīng)濟(jì)與網(wǎng)約車服務(wù)的內(nèi)在聯(lián)系。著眼我國目前對網(wǎng)約車服務(wù)的法律規(guī)制現(xiàn)狀,借鑒國外網(wǎng)約車服務(wù)規(guī)制的有益經(jīng)驗(yàn),對我國網(wǎng)約車服務(wù)法律規(guī)制中現(xiàn)存的問題進(jìn)行分析,并提出具體的改善建議。
[Abstract]:With the rapid development of network science and technology and the popularity of smart phones, with its convenient, comfortable and fast operation characteristics, it is loved by the vast number of consumer groups, and has become the most popular way for residents to travel.The rapid development of ride-sharing is mainly due to the global rise of the sharing economy and the convenience of information exchange in the context of the Internet.The theory of sharing economy provides a theoretical support for the development of ride-sharing services. The convenience of information communication in the context of the Internet reduces the cost of social information exchange. In such an environment, ride-sharing services emerge as the times require.China's ride-sharing service started relatively late, but the rapid development momentum emerged DiDi, Shenzhou special car and other successful network ride-hailing service platforms, the network ride-hailing service has changed the traditional way of travel.It brings great convenience to people's daily life.But at the same time, there are many new problems in the development of ride-sharing service. The safety factor of ride-sharing service is worrying.Net car-sharing traffic accident claims no door, consumers face shirking the responsibility of the parties can not do anything.Ride-hailing services participate in many ways, and the determination of tax collection has also become a major problem in tax work and so on.In view of this, the government began to strengthen the management and regulation of the ride-hailing service, but because of the lack of a unified and clear regulation, the local governments are doing their own things, so it is difficult to jump out of the traditional taxi management mode for the regulation of the network-ride-hailing service.Did not achieve the intended purpose.How to regulate the new type of ride-hailing service by law, not only to ensure its healthy development, but also to overcome its own problems, has become an urgent problem in front of us.This paper selects DiDi as the observation angle, probes into the development, nature and operation mode of the ride-hailing service, and deeply analyzes the internal relationship between the sharing economy and the ride-hailing service.This paper focuses on the current situation of legal regulation of ride-hailing service in our country, draws lessons from the beneficial experience of foreign countries, analyzes the existing problems in the legal regulation of ride-hailing service in China, and puts forward some concrete suggestions for improvement.
