【摘要】：國際法與國內(nèi)法的互動是法律發(fā)展一種普遍規(guī)律,普遍存在所有法律領(lǐng)域�；右彩菄H法與國內(nèi)法相互作用的方式,在國際投資法與東道國國內(nèi)法之間也必然普遍存在互動。由于國際投資法主要由雙邊投資協(xié)定構(gòu)成,所以本文將研究范圍確定在雙邊投資協(xié)定與國內(nèi)法的互動。本文第二部分首先對雙邊投資協(xié)定與國內(nèi)的互動基礎(chǔ)進行闡述。通過說明國際投資規(guī)制的雙重性；雙邊投資協(xié)定與國內(nèi)法的相互補充；雙邊投資協(xié)定與國內(nèi)法的沖突來說明雙邊投資協(xié)定和國內(nèi)法的互動基礎(chǔ)。然后在第三部分對雙邊投資協(xié)定與國內(nèi)法的沖突的具體表現(xiàn)從法律角度進行具體說明,以求進一步完善雙邊投資協(xié)定與國內(nèi)法互動框架的基礎(chǔ)理論。法律的工具價值只有在運用過程中得到體現(xiàn)。本文四、五部分將分別對雙邊投資協(xié)定與國內(nèi)法的具體互動方式以及互動的特征進行說明以及分析。第四部分從直接適用、國際法國內(nèi)化、國內(nèi)法國際化三個方面來具體說明雙邊投資協(xié)定與國內(nèi)法的互動方式,并總結(jié)出雙邊投資協(xié)定與國內(nèi)法的互動限度。第五部分則結(jié)合雙邊投資協(xié)定的內(nèi)容和雙邊投資協(xié)定與國內(nèi)法互動的方式歸納兩者互動的特征。在第六部分中文本結(jié)合前述的分析以及雙邊投資協(xié)定與國內(nèi)法的互動理論以及中國目前在國際投資領(lǐng)域的角色、需求對中國國際投資法建言。
[Abstract]:The interaction between international law and domestic law is a universal law of law development.Interaction is also a way of interaction between international law and domestic law, and there must be a general interaction between international investment law and the domestic law of host country.Since the international investment law is mainly composed of bilateral investment agreements (bits), the scope of this study is determined by the interaction between bilateral investment agreements (bits) and domestic laws.The second part of this paper first describes the basis of bilateral investment agreement and domestic interaction.By explaining the duality of international investment regulation, the complementarity between bilateral investment agreement and domestic law, and the conflict between bilateral investment agreement and domestic law, the paper explains the basis of interaction between bilateral investment agreement and domestic law.Then in the third part, the author explains the conflict between bilateral investment agreement and domestic law from the angle of law, in order to further improve the basic theory of the framework of the interaction between bilateral investment agreement and domestic law.The instrumental value of law can only be reflected in the process of application.The fourth and fifth parts of this paper will explain and analyze the specific interactive mode and characteristics of bilateral investment agreement and domestic law.The fourth part explains the interaction mode of bilateral investment agreement and domestic law from three aspects of direct application, international law internalization and domestic law internationalization, and summarizes the interaction limit between bilateral investment agreement and domestic law.The fifth part combines the content of bilateral investment agreement and the way of interaction between bilateral investment agreement and domestic law.In the sixth part, combining the above analysis, the theory of interaction between bilateral investment agreement and domestic law, and the role of China in the field of international investment, it is necessary to advise on China's international investment law.
