【摘要】：隨著國內(nèi)市場化程度不斷提高、我國法制環(huán)境不斷完善，法商管理是快速發(fā)展的企業(yè)管理思想。實質(zhì)是可持續(xù)性發(fā)展的管理。法商管理強調(diào)法是為商服務(wù)的，商要符合法的規(guī)定，兩只緊密結(jié)合，互相促進。其形成具有一定的必然性，其核心是倡導(dǎo)從之前的追求利益最大化的“純商業(yè)管理”轉(zhuǎn)變?yōu)榉献匀话l(fā)展規(guī)律的、可持續(xù)發(fā)展的“法商管理”商業(yè)管理之道。 本文在自己多年法律研究和法律服務(wù)實踐經(jīng)驗和知識的基礎(chǔ)上，在充分考慮東營攀登公司面臨的內(nèi)、外部環(huán)境，通過態(tài)勢分析，明確企業(yè)自身的優(yōu)勢、缺陷、機會、威脅、本身存在的問題和可能產(chǎn)生的風(fēng)險等，參考法商管理的理論，試圖通過運用法商管理的研究方法、結(jié)合調(diào)查法、文獻研究法、系統(tǒng)科學(xué)方法、系統(tǒng)分析法對攀登公司從成功經(jīng)營到破產(chǎn)進行深入的研究。 本文試圖通過對東營攀登公司經(jīng)營失敗的法商管理分析，，找出國內(nèi)企業(yè)在法商管理方面的缺陷，使得我國企業(yè)可以從公司戰(zhàn)略發(fā)展角度有所借鑒，能夠更好、可持續(xù)的發(fā)展。
[Abstract]:With the improvement of domestic marketization and the perfection of legal environment in China, the management of law and commerce is a rapidly developing idea of enterprise management.The essence is the management of sustainable development.The law management emphasizes that the law is to serve the business, and the business must conform to the law, and the two should closely combine and promote each other.Its formation has certain inevitability, its core is to advocate the change from "pure commercial management" which pursues the benefit maximization before to the "legal business management" commercial management way which accords with the natural development law and the sustainable development.On the basis of many years' experience and knowledge of legal research and legal service practice, this paper fully considers the internal and external environment facing Dongying climbing Company, and through situation analysis, clarifies the advantages, defects, opportunities and threats of the enterprise itself.With reference to the theory of law and business management, this paper tries to apply the research methods of law business management, combined with investigation method, literature research method, system scientific method, etc.System analysis method to climb the company from successful operation to bankruptcy in-depth study.This paper attempts to find out the defects of domestic enterprises in the aspect of legal business management by analyzing the failure of Dongying's business management, so that Chinese enterprises can learn from the perspective of the company's strategic development and be able to develop better and sustainably.
