【摘要】：政府購買服務在中國以多種方式迅速推進,社會資本也積極參與其中。然而,實踐中法權(quán)分配的不平衡、法律規(guī)制的不完備也逐漸暴露出潛在的制度漏洞。通過引入法權(quán)分析的方法,對政府購買服務的法權(quán)嘗試進行具體分析與應然建構(gòu),以期為該制度發(fā)展和科學立法有所助益。
[Abstract]:Government purchases of services in China are advancing rapidly in many ways, and social capital is actively involved in them.However, the imbalance of the distribution of legal power and the imperfection of legal regulation in practice have gradually exposed the potential institutional loopholes.By introducing the method of legal power analysis, this paper makes a concrete analysis and construction of the legal right of the government to purchase services in order to help the development of the system and the scientific legislation.
