【摘要】：合同自由原則是作為私法的合同領(lǐng)域最基本的準(zhǔn)則,無(wú)論合同的類(lèi)型如何,我們都能在其中尋覓到合同自由原則的身影。誠(chéng)然,在海上貨物運(yùn)輸領(lǐng)域,國(guó)際上制定海上貨物運(yùn)輸公約主要是出于建立強(qiáng)制性運(yùn)輸責(zé)任體制的需要,因此在談及海上貨物運(yùn)輸公約時(shí),我們更多地想到的是其強(qiáng)制性。圍繞著海上貨物運(yùn)輸公約下的強(qiáng)制性體制,眾多學(xué)者展開(kāi)了深入細(xì)致的研究,并取得了豐碩的研究成果。故而,筆者在此不再在此對(duì)其進(jìn)行研究,而研究與之相對(duì)且研究較少的海上貨物運(yùn)輸公約下的合同自由原則。海上貨物運(yùn)輸公約的主旨是調(diào)整海上貨物運(yùn)輸關(guān)系,而談到這種關(guān)系,必然會(huì)離不開(kāi)合同,海上貨物運(yùn)輸合同是合同領(lǐng)域重要的家族成員之一,作為合同領(lǐng)域基本準(zhǔn)則的合同自由原則當(dāng)然也同樣貫穿海上貨物運(yùn)輸合同始終。本文立足于海上貨物運(yùn)輸公約,以合同自由原則的歷史變遷為切入點(diǎn),通過(guò)歷史研究法、比較研究法、法經(jīng)濟(jì)學(xué)研究方法等,對(duì)海上貨物運(yùn)輸公約下的合同自由原則進(jìn)行了深入研究,并對(duì)合同自由原則在我國(guó)海上貨物運(yùn)輸領(lǐng)域的運(yùn)用問(wèn)題,提出了一己之見(jiàn)。全文共分為四章：第一章簡(jiǎn)要介紹海上貨物運(yùn)輸公約下合同自由原則研究的必要性；第二章重點(diǎn)分析合同自由原則在四大海上貨物運(yùn)輸公約下的歷史演進(jìn)狀態(tài)；第三章主要是在第二章海上貨物運(yùn)輸公約下合同自由原則變遷史的基礎(chǔ)上,研究這種變遷的趨勢(shì)、變遷緣由等；第四章主要是對(duì)我國(guó)海上貨物運(yùn)輸法的修改提出的一己之見(jiàn)。
[Abstract]:The principle of freedom of contract is the most basic rule in the field of contract in private law. We can find the principle of freedom of contract in the field of carriage of goods by sea, regardless of the type of contract. International conventions on the carriage of goods by sea are formulated primarily out of the need to establish a mandatory liability regime for carriage of goods by sea, so when it comes to conventions on the carriage of goods by sea, We think more about its compulsion. Around the mandatory system under the Convention on the Carriage of goods by Sea, many scholars have carried out in-depth and meticulous research, and have achieved fruitful results. The author no longer studies it here, but studies the principle of freedom of contract under the Convention on the Carriage of goods by Sea, which is relatively few. The main purpose of the Convention on the Carriage of goods by Sea is to adjust the relationship between carriage of goods by sea, but to talk about this relationship. The contract of carriage of goods by sea is one of the important family members in the field of contract. Of course, the principle of freedom of contract, which is the basic criterion in the field of contract, also runs through the contract of carriage of goods by sea. This paper bases itself on the Convention on the Carriage of goods by Sea, takes the historical change of the principle of freedom of contract as the starting point, and adopts the historical research method. The comparative research method, the law economics research method and so on, have carried on the thorough research to the freedom of contract principle under the convention of carriage of goods by sea, and has carried on the question to the application of the freedom of contract principle in the field of the carriage of goods by sea in our country. The thesis is divided into four chapters: the first chapter briefly introduces the necessity of the study on the principle of freedom of contract under the Convention of Carriage of goods by Sea; The second chapter focuses on the analysis of the historical evolution of the principle of freedom of contract under the four maritime conventions on the carriage of goods; the third chapter mainly studies the trend of the change of the principle of freedom of contract on the basis of the history of the change of the principle of freedom of contract under the second chapter of the convention on the carriage of goods by sea. The fourth chapter is about the revision of China's law of carriage of goods by sea.
