【摘要】:國(guó)際船舶登記制度是在一個(gè)國(guó)家原有的登記體系內(nèi),保留原有的傳統(tǒng)登記制度基礎(chǔ)上,對(duì)從事國(guó)際航運(yùn)的懸掛方便旗的本國(guó)船東或外國(guó)船東進(jìn)行登記的一種制度。此種制度與國(guó)內(nèi)傳統(tǒng)的登記制度并行,但與之相比卻具有很大的優(yōu)勢(shì)。縱觀實(shí)行國(guó)際船舶登記制度的各傳統(tǒng)海運(yùn)國(guó)家,無(wú)論是在具體措施上有哪些不同,但無(wú)一不在登記準(zhǔn)入條件方面有所放寬,并且沒(méi)有失去對(duì)船舶進(jìn)行有效的管轄和控制。所以,國(guó)際船舶登記制度是一種兼具兩種制度優(yōu)點(diǎn),同時(shí)又能彌補(bǔ)兩種制度不足的登記模式,是當(dāng)代航運(yùn)市場(chǎng)不斷發(fā)展的產(chǎn)物。我國(guó)船舶國(guó)籍登記實(shí)行嚴(yán)格登記,此種登記對(duì)船舶所有人的國(guó)籍、雇用外國(guó)船員的比例、船舶征稅以及船舶檢驗(yàn)方面都有嚴(yán)格的要求。長(zhǎng)期實(shí)行此種登記制度導(dǎo)致越來(lái)越多的“國(guó)輪”移籍,許多船東為了降低營(yíng)運(yùn)成本,選擇到登記條件寬松,稅費(fèi)征收較低的國(guó)家進(jìn)行登記,為我國(guó)的航運(yùn)業(yè)帶來(lái)極大沖擊,使得航運(yùn)實(shí)力下降。為了改變這種不利局面,我國(guó)在吸引移籍“國(guó)輪”回國(guó)登記的道路上不斷探索,國(guó)際船舶登記制度是我國(guó)在借鑒傳統(tǒng)海運(yùn)國(guó)家經(jīng)驗(yàn)基礎(chǔ)上進(jìn)行的新嘗試。本文對(duì)國(guó)際船舶登記制度進(jìn)行深入研究,并且在此基礎(chǔ)上探討該制度在我國(guó)實(shí)行過(guò)程中遇到的阻礙,以及當(dāng)下我國(guó)的航運(yùn)市場(chǎng)環(huán)境以及相關(guān)政策能否對(duì)此種登記制度的順利推進(jìn)提供良好助力,在此基礎(chǔ)上提出完善建議。本文共分為四章,第一章對(duì)國(guó)際船舶登記制度進(jìn)行概述,并且對(duì)國(guó)際船舶登記制度的概念、法律屬性以及特點(diǎn)進(jìn)行詳細(xì)的闡述。第二章在第一章的基礎(chǔ)上,分析了國(guó)際船舶登記制度的主要內(nèi)容。第三章以天津東疆保稅港區(qū)實(shí)行的國(guó)際船舶登記制度為例,實(shí)證分析國(guó)際船舶登記制度在我國(guó)的推進(jìn)過(guò)正中面臨的問(wèn)題與挑戰(zhàn),最后一章對(duì)該制度更好地推進(jìn)提供完善建議。
[Abstract]:The international ship registration system is based on the original registration system of a country and the maintenance of the original traditional registration system. A system for the registration of national or foreign shipowners flying flags of convenience engaged in international navigation... such a system parallels traditional domestic registration systems, However, there is a great advantage in comparison. Throughout the traditional maritime countries that have implemented the international ship registration system, regardless of the differences in specific measures, none of them has relaxed the conditions for registration access. Therefore, the international ship registration system is a kind of registration mode which has the advantages of both systems, and can make up for the insufficiency of the two systems at the same time. It is the product of the continuous development of the contemporary shipping market. The registration of the nationality of ships in our country is strictly registered. Such registration is of the nationality of the shipowner and the proportion of the foreign crew employed. There are strict requirements in ship taxation and ship inspection. The long-term implementation of such a registration system has led to an increasing number of "national ship" registrations. In order to reduce operating costs, many shipowners have opted for lenient registration conditions. The registration of countries with lower taxes and fees has brought great impact to the shipping industry in our country and reduced the strength of shipping. In order to change this unfavorable situation, our country has been constantly exploring the road of attracting the "country ship" to return to China for registration. The international ship registration system is a new attempt based on the experience of the traditional maritime shipping countries. This paper makes a deep study of the international ship registration system, and on this basis discusses the obstacles encountered in the implementation of the international ship registration system in China. And the current shipping market environment and related policies can provide a good contribution to the smooth advancement of the registration system, on the basis of this, put forward some suggestions. This paper is divided into four chapters, the first chapter is an overview of the international ship registration system. And the concept, legal attributes and characteristics of the international ship registration system are elaborated in detail. The second chapter is based on the first chapter. This paper analyzes the main contents of the international ship registration system. The third chapter takes the international ship registration system implemented in Tianjin Dongjiang bonded Port area as an example to empirically analyze the problems and challenges faced by the international ship registration system in our country. The last chapter provides the perfect suggestion for the system to advance better.
