【摘要】：由于我國經(jīng)濟(jì)的發(fā)展,民間借貸的行為也不斷增多,隨之而來的糾紛也越來越多,也就有很多的法律上的缺陷暴露出來了。于是,最高人民法院在2015年9月1日頒布了《最高人民法院關(guān)于審理民間借貸案件適用法律若干問題的規(guī)定》。這一司法解釋在一定程度上使民間借貸得到了法律的保護(hù),但是,目前法律制度對民間借貸違法犯罪的規(guī)定不完善。本文結(jié)合現(xiàn)在社會(huì)中出先的問題分析民間借貸形成的原因,以及民間借貸在法律法規(guī)存在的缺陷,為進(jìn)一步完善民間借貸制度提出一些建議。
[Abstract]:With the development of our country's economy, the behavior of folk borrowing has been increasing, and the disputes that have followed have become more and more, and a lot of legal defects have been exposed. As a result, On September 1, 2015, the Supreme people's Court promulgated the provisions of the Supreme people's Court on several issues applicable to the trial of private lending cases. To some extent, this judicial interpretation has protected private lending by law, but, The current legal system is not perfect for the illegal and criminal provisions of private lending. This paper analyzes the reasons for the formation of folk lending and the defects of folk lending in laws and regulations in light of the problems in the present society. In order to further improve the private lending system put forward some suggestions.
