【摘要】:隨著互聯(lián)網(wǎng)技術(shù)的飛速發(fā)展,網(wǎng)絡(luò)購物以其便利快捷、價(jià)格優(yōu)惠、品類齊全等優(yōu)勢,快速發(fā)展成為互聯(lián)網(wǎng)時(shí)代中極為重要的新型交易模式。但是,網(wǎng)絡(luò)交易方便大眾的同時(shí)也存在著許多問題。因?yàn)榫W(wǎng)絡(luò)交易特有的虛擬性,網(wǎng)絡(luò)交易消費(fèi)者在面對同種類商品時(shí),判斷和評價(jià)商品的好壞很大程度上依賴網(wǎng)絡(luò)交易經(jīng)營者對商品的介紹以及其他網(wǎng)絡(luò)交易消費(fèi)者在完成交易后所提供的評價(jià)。其中,網(wǎng)絡(luò)交易經(jīng)營者在經(jīng)營過程中所累積的信用評價(jià),對于網(wǎng)絡(luò)交易消費(fèi)者來說是最為重要的參考依據(jù)。由此,一些不法經(jīng)營者為了獲得更高的成交量,牟取更多的利潤,選擇利用好評返現(xiàn)、刷信譽(yù)、惡意差評、強(qiáng)迫刪除中差評等手段,提高自身的信用評價(jià),以此誘導(dǎo)其他網(wǎng)絡(luò)交易消費(fèi)者與之進(jìn)行交易。以上所列舉的不正當(dāng)獲取信用評價(jià)的行為對網(wǎng)絡(luò)交易消費(fèi)者的知情權(quán)、隱私權(quán)造成了嚴(yán)重的損害,也因?yàn)樽鞒鎏摷傩麄骱蜕虡I(yè)詆毀的網(wǎng)絡(luò)交易不正當(dāng)信用評價(jià)行為,使其他誠信經(jīng)營的同業(yè)競爭者喪失交易機(jī)會(huì),損害了網(wǎng)絡(luò)交易平臺的經(jīng)濟(jì)利益,擾亂公平競爭的網(wǎng)絡(luò)交易秩序。然而,我國目前有關(guān)網(wǎng)絡(luò)交易方面的法律法規(guī)還不全面,針對網(wǎng)絡(luò)交易不正當(dāng)信用評價(jià)行為的法律規(guī)制更是不完善。對于網(wǎng)絡(luò)交易消費(fèi)者來說,按照我國現(xiàn)有法律規(guī)定,在通過司法途徑進(jìn)行維權(quán)時(shí),關(guān)于管轄法院、電子證據(jù)取證、舉證責(zé)任分配都會(huì)陷入不利地位。對于作出不正當(dāng)網(wǎng)絡(luò)交易信用評價(jià)行為的網(wǎng)絡(luò)交易經(jīng)營者的執(zhí)法監(jiān)管方面,行政執(zhí)法權(quán)限模糊、行政執(zhí)法效能低下都是較為突出的問題。另外,對于網(wǎng)絡(luò)交易平臺的自我管理也缺乏明確的法律地位和法律義務(wù),導(dǎo)致許多網(wǎng)絡(luò)交易平臺提供者對網(wǎng)絡(luò)交易不正當(dāng)信用評價(jià)行為持縱容態(tài)度。因此,本文結(jié)合我國法律規(guī)制現(xiàn)狀,借鑒域外法律規(guī)制經(jīng)驗(yàn),針對目前法律規(guī)制中的具體問題,為我國完善網(wǎng)絡(luò)交易不正當(dāng)信用評價(jià)行為的法律規(guī)制提出建議。本文除引言和結(jié)語外分為四部分:文中的第一部分是對網(wǎng)絡(luò)交易中獲取不正當(dāng)信用評價(jià)的行為進(jìn)行了介紹。首先介紹的是網(wǎng)絡(luò)交易信用評價(jià)的相關(guān)概念,然后對網(wǎng)絡(luò)交易不正當(dāng)信用評價(jià)行為作出法律認(rèn)定。介紹了現(xiàn)階段網(wǎng)絡(luò)交易不正當(dāng)信用評價(jià)行為主要體現(xiàn)在好評返現(xiàn)、刷信譽(yù)、惡意差評和網(wǎng)絡(luò)交易經(jīng)營者強(qiáng)迫網(wǎng)絡(luò)交易消費(fèi)者刪除中差評等不良現(xiàn)象。種種不正當(dāng)信用評價(jià)行為嚴(yán)重侵害了網(wǎng)絡(luò)交易消費(fèi)者的知情權(quán)和隱私權(quán),也搶占了同業(yè)競爭者的交易機(jī)會(huì),同時(shí)對網(wǎng)絡(luò)交易平臺提供者的商譽(yù)和網(wǎng)絡(luò)交易正常秩序也帶來了極大的損害。第二部分首先闡述的是當(dāng)下國內(nèi)對網(wǎng)絡(luò)交易不正當(dāng)信用評價(jià)行為的法律規(guī)制情況,接下來在網(wǎng)絡(luò)交易消費(fèi)者受到網(wǎng)絡(luò)交易不正當(dāng)信用評價(jià)行為侵害時(shí)維權(quán)難、對進(jìn)行網(wǎng)絡(luò)交易不正當(dāng)信用評價(jià)行為的經(jīng)營者監(jiān)管弱以及網(wǎng)絡(luò)交易平臺提供者縱容網(wǎng)絡(luò)交易不正當(dāng)信用評價(jià)行為三個(gè)方面,闡釋我國目前對網(wǎng)絡(luò)交易不正當(dāng)信用評價(jià)法律規(guī)制存在的不足。第三部分為域外對網(wǎng)絡(luò)交易不正當(dāng)信用評價(jià)行為的法制經(jīng)驗(yàn)及借鑒。通過了解德國、美國、歐盟、日本以及韓國現(xiàn)有的法律規(guī)制經(jīng)驗(yàn),對完善我國網(wǎng)絡(luò)交易不正當(dāng)信用評價(jià)行為的法律規(guī)制提供經(jīng)驗(yàn)借鑒。第四部分是對我國完善網(wǎng)絡(luò)交易不正當(dāng)信用評價(jià)行為法律規(guī)制提出的建議。針對網(wǎng)絡(luò)交易中如何優(yōu)化網(wǎng)絡(luò)交易消費(fèi)者的維權(quán)制度、如何完善網(wǎng)絡(luò)交易經(jīng)營者的監(jiān)管制度以及如何健全網(wǎng)絡(luò)交易市場內(nèi)部的管理制度三個(gè)角度進(jìn)行分析。
[Abstract]:With the rapid development of Internet technology, online shopping with its convenient, price concessions, complete category and other advantages, rapid development becomes an extremely important new trading mode in Internet era. However, the network transaction convenience of the public at the same time there are also many problems. Because the virtual network transaction is unique, consumers in the face of the same types of goods, evaluation judgment and evaluation of the quality of the commodity trading network operators rely heavily on the product description and other online trading consumer that after the completion of the transaction. The credit evaluation of network exchange operator, accumulated in the course of business, for consumers is the most important reference for this. Some unscrupulous operators, in order to obtain a higher volume, making more profits, choose to use praise back now, brush reputation, malicious bad review, Force rating means poor delete, improve the credit evaluation of their own, in order to induce other consumers with transactions. However, China's current relevant laws and regulations of network transactions is not comprehensive, the legal regulation for online transactions unfair credit evaluation behavior is not perfect. For consumers, in accordance with the provisions of the existing law of our country, the rights through judicial means, on the jurisdiction of the court, electronic evidence The evidence, the distribution of the burden of proof will be in a disadvantageous position. For the law enforcement supervision made unfair credit evaluation network behavior in the network transaction operator, the administrative law enforcement authority is fuzzy, low efficiency of administrative law enforcement is a prominent problem. In addition, the lack of legal status and legal obligation for a clear self management network trading platform that caused a lot of online trading platform provider of network transactions unfair credit evaluation behavior connivance. Therefore, this paper combined with the status quo of China's legal regulation, from the extraterritorial legal regulation of experience, for the specific issues in the legislation, put forward suggestions for the improvement of the legal regulation of network transactions unfair credit evaluation behavior in our country. In addition to this the introduction and conclusion is divided into four parts: in the first part of this paper is to obtain unfair credit evaluation behavior in network transactions are introduced. The third part is the extraterritorial legal experience of Internet unfair credit behavior evaluation and reference. Through the understanding of the United States, Germany, the EU, Japan and South Korea the existing legal regulation, perfecting legal system of our country network transactions unfair credit evaluation behavior to provide experience for reference. The fourth part is to improve the present legal regulation of network transaction unfair credit evaluation behavior. According to the suggestions on how to optimize the network the transaction system of consumer rights in network transactions, how to improve the network exchange operator supervision system and how to improve the network transaction The management system within the market is analyzed in three angles.
